Friend needs advise -

Hi,

Making this topic for a friend.

Over the years he's got allot of bank charges and he won most back when it was not so bad to get the charges back (He's got over £8000 back of charges) However over the last 2-3 years he's found it impossible to get the charges back through the old steps he took, and now his old bank (Halifax which he reclaimed loads back before he could not no more) Has past on a £900 debt that is all from bank charges he was unable to reclaim to another debt collecting company. (He's had a few contact him before also but he's ignored them as he dont know what to do now with the bank charges situation changed)

My mate is now with Bank of Scotland wh he's been happy with, but let me note the letter down here for you as this is a bit confusing.
Halifax etc

Account No:(His old account he don't have now)

Reference: Bank of Scotland plc

We are writing to notify you that Bank Of Scotland plc has assigned all of it's respective rights, title and interest in respect to the above reference account (Including the outstanding balance) to 1st CREDIT (FINANCE) 5 LIMITED, effective 31/07/12.

The total balance sold was £960.91 as at the date of sale 31/07/2012. Any payments made towards your Bank of Scotland plc account after 31/07/2012 will be forwarded to 1st Credit Limited and will be deducted from the balance shown above.

1st Credit Limited has been appointed by 1ST CREDIT (FINANCE) 54 LIMITED, to manage your account and it is essential that all future payments and correspondence regarding this account be directed to 1st Credit Limited:

Then there's letter from 1ST Credit (with payment options etc)

Questions are, why do they mention the Bank OF Scotland account? Have Halifax and bank of Scotland merged? Can halifax get the bank of scotland details and then take money from hius next payday from his current account?

The letter sounds like Halifax are saying they will take the money out of his bank of Scotland account, is this possible etc? Sorry my friend is a bit confused.

What advise can you give him to send back to Halifax and any general advise is welcome.

    A quick check of the Halifax website indicates that Halifax is a division of Bank of Scotland plc.

    Whilst reclaiming bank charges was as simple as asking for them back many years ago, that gravytrain was put a stop to finally when the Supreme Court made their decision 3 years ago.

    Refer to the MSE guide on reclaiming bank charges for further details and the specific occasions a refund may now be forthcoming from a bank.

    Banks usually include within their terms a facility that allows debts on one account to be recovered via another account held by that bank. Your friend should refer to his own terms.

    My advice, although I doubt he wants to hear it, is to contact his creditor and arrange to settle his debts. He may be able to negotiate an agreeable repayment plan rather than have the lot taken out in one go.
  • Okay thanks for the reply and information. It seems the only way out of these situations now is just to pay and setup another monthly payment (Even if you cant afford it)
