Threatened with small claim court when I have paid and got receipt

I have a flat in a converted house. Service management is handled by Service Management company which flat owners have appointed.

We have had some remedial work done on the building and because some of the flat owners were tardy in sending in the required money we have incurred an extra charge.

All good so far - I have paid both parts and have documented evidence that I have done this.

This morning I received a letter from the Service Management Company threatening me with small claims court. My concern is that they have sent this letter to all flat owners - there was a compliment slip saying for your records - but the threat letter was addressed to me.

Obviously phoned (answer phone) and emailed today, but I am upset and very annoyed.

I need to find out if others have been informed - but what else would you advise? So wish wasn't the weekend - have to wait until Monday to sort it!

    Wait until you contact them. If they continue to pursue it, let them. And when it goes to court, counter claim for your costs.

    If you have documented evidence showing that you have paid everything due why are you worrying?

    It will probably turn out to be a simple mistake.

    Have a good weekend and wait until you can speak to them.

    They will not take you to Small Claims Court if you can show them proof of payment. It is just a threat to the tardy payers to get them to pay up.

    If your letter has a compliment slip attached saying "for your records" I would view it as the Management Company informing you that court action is being pursued for those who have not yet subbed up their share, ie .it may be the Management Company showing you that they are not letting others just get away with being late/not paying at all.

    However, if the original "extra charge" for the late payment misdemeanour of some of the flat owners had to be shared amongst all it may be that there could be other charges levied in the same way if payment is still not forthcoming, but building up a head of steam in the interim won't change anything, but will ruin what's left of your w/e.

    Put it away for now and speak to them on Monday.
