Quick bit of advice RE Notice and LA & Over staying

Hi everyone,

I'm in the proceeds of purchasing a house.

Served notice correctly as I'm on a rolling contract so tenancy will end on 4th Sept. I'm in the UK. Deposit it protected.

However, the day after I served notice we got some papers from the solicitor regarding a search that needs doing, and could potentially take a few weeks to come back, which means our completion date that the sellers and ourselves agreed on could be pushed back past my end of tenancy date.

I just want to know what the legalities are concerning this from the LA point of view.

We get on very well with the Landlord and have kept them aprised of the situation, they are happy for us to over stay, and pay another months rent, then have it refunded (pro rata) should we move out mid month in Sept.

I'm going to ring the agency and explain our situation, but just want some grasp of what they could come back at me with legally and how actually likely it is to occur.

    If the LL has agreed, then the LA will just have to go along with that. The agent works for the LL, not the other way round. The LL is being generous, but that is their prerogative. Do you have this agreement in writing? This is VERY important.

    When you approach the LA (with the written agreement) I would adopt the line that "I have agreed X with the LL. I will inform you when dates are confirmed to arrange checkout inspection".

    If you overstay by even 1 day you are legally due to pay the whole month, there are no pro-rata months for rental payments under law (*in most situations).

    'most situations' = if rent paid in advance and unless landlord agrees otherwise.
