Advice please. WTC

I made an amendment to my working tax credit claim of 2010/11

I declared my self employment wage amount and not just my profit, which i was unaware of at the time.

I made the change which ment that i was due a refund.

I rang the WTC helpline to see the progress of the refund but i was told that i would not be receiving it as it was past the deadline.

Now, im not being funny but if i owed them money from 4 years ago im sure they would be chasing me up for it, but because they owe me money they think its fine not to pay it back to me.

Can i do anything about? or havnt i got a leg to stand on.

    The tax credits system is set up so self-employed people have adequate time to get their final figures in.

    You should have given your 2010/11 estimate by 31 July 2011. Then you have until 31st January 2012 (the date your tax return has to be in) to finalise your figures.

    So presuming you submitted your tax return on time, there should have been time to tell HMRC of your actual 10/11 profit figure.

    Outside of that deadline, there are only certain ways of re-opening an award and this isn't one of the reasons you can re-open it. (Unless you are within the appeal time limit for the last 10/11 notice)

    yes i did submit my tax return on time.
    The reason i changed my final income was because i only recently found out that i was to submit my profit and not my entire wage.
    I changed my 2011/12 figure when i found out and got a refund for that but they say that i was outside the deadline for the 2010/11 rewards.

    Ill look into the appeal deadlines. see if i have past it or not.

    it would seem, if i am reading this correctly. That i have 13 months to appeal a decision.

    Meaning that the deadline for the 2010/11 award was jan 2012
    And i have untill march 2013.
    Ill try and get some independant advice about this issue and see if i can get somewhere.

    The 13 months runs from the date on your last award notice. So if you have one dated in January 2012, you will have 13 months from the date on that notice. However, that is only if you can show good cause for appealing late.

    If you look at the notes that come with the renewal packs, it tells you which box on the tax return to take the figure wrong. So HMRC might have an argument to say that you should have followed the instructions and therefore there is no good cause. That said, they are normally ok at allowing late appeals.

    You can download the appeal form (WTC/AP) from the website and send it off. You just need to know the date of final decision and tell them that the income is wrong and give them a good reason why you are making the appeal late. As I say, the forms do tell you the exact box number to use from your tax return, so you will need a reason why you were not able to follow that.
