End of line laptop, money taken but item unavailable

Hi

I purchased a Sony Vaio laptop from Dixons. It was a great deal, got the confirmation email, money taken etc. I have just been told that they have no stock left and that I ordered the last one at the same time as someone else.

What are my choices? Can I get Dixons to provide me with a similar specced laptop regardless of price (like for like) due to the fact that a 'contract' has been formed or would they just offer me another laptop of similar price with far lower specs.

How far can I push this?

I am annoyed about this.

    They have to put you back in a position you were before the contract was formed (i.e. a refund).

    You could try getting compensation by sueing for "loss of bargain", but good luck with that...

    Read their terms and conditions, most online operations include in their terms and conditions that a contract is formed up on dispatch.

    In all honesty you don't have many (if any) options other than go elsewhere.

    ADDING:

    from their website
    You’ll then receive an email headed ‘Order Acknowledgement’ recognising receipt of your order. We will then send a further email headed ‘Order Confirmation’ and this is when our contract with you begins. This second email also lets you know how your products will be delivered to you. If we have to cancel all or part of your order for any reason, we will email you to let you know.
  • Well, just got an order confirmation email with a tracking number. Parcel picked up and ready to be delivered tomorrow. Maybe they found another one in the back??

    Now I'm confused!

    Maybe the other person who bought at the same time as you has changed their mind
