Budgeting loan 26 week rule?

My IB and IS stopped in May so my wife claimed IS in her name and we would like to apply for a budgeting loan but does the 26 week rule stand or as the IS claim was in my name before would that count towards the 26 weeks of having to get IS before we could apply for a loan?

  • Did your claim for IB & IS include your wife as part of the claim, if it did I think she can claim and use the weeks she was on a joint claim towards the weeks

    Not sure.

    but it was in my name.

    on my claim it had that i was ill and that she was my carer(still is)

    It should link for the twenty six weeks entitlement as long as there were no gaps in between your claim ending and hers beginning.
    If there are and its just one day the twenty six weeks will begin again from her date of claim

    Assuming they were both on each other's claim, does that allowance for a break of up to 28 days no longer apply?

    Yes sorry it does just checked it, a customer had said they had been refused one because of a one day gap, but must have been wrong :(
