Incapacity benifit stopped,told could have claim more money for partner now :(

Hi,All... Bare with me i`m new to this site. .
Ok where do I start lol,
Had medical for I.b other month was turned down so am appealing,been informed I am going to get a rate of £71.00 a week for single person but I am living with partner which I have for last 11 years,so they are going to send out a form so I can claim a extra £40 pounds a week on top to make it £110 every week for couple rate,I said I couldn't understand why this wasn't awarded in first place,They said the incapacity claim was only for a single person which im sure it should have been for couple they said you cant claim as a couple for I.B but you can get extra money for your partner on top? they told me now :( no good now. can I get any of this money back? is this right? any idea`s people,No one even said I could have got extra money for her on top?Aaron

    Your medical was actually for ESA not IB as everyone is being transferred. With IB you could claim IS as a top up if the household had a low income and savings. As you were on IB then you were assessed for contribution based ESA but could claim income based on top if as before household income and savings are low.

    As both IB and contribution ESA can be claimed regardless of other money you need to claim the income related aspect. Is your partner working and do you have savings which would affect this?

  • Hi,thanks for response.. At moment i`m on esa appeal rate and partner is looking after our 7 months baby,we have no savings,been told to fill in a form to get my partner added onto my esa claim so money will go from 70 pw to 111pw
  • any idea`s people??
