Register a company - Name in Administration

Hi guys,

Hope you're all having a good Sunday. I want to register my first company and I have a name I REALLY want.

The problem is, its taken, but the company that owns it is in adminisitration. It has "R" status which means Other insolvency type. These are the details of the comapny:


Status: In Administration
Last Accounts Made Up To: 12/2009 (FULL)
Next Accounts Due: 09/2011 OVERDUE
Last Return Made Up To: 06/2011
Next Return Due: 07/2012 OVERDUE


My question is, can I now register a company with that name, or do I have to wait for the name to become dissolved. If that is the case, how long do I have to wait for that.

I've tried googling this without a lot of luck so any help would be awesome.

    The company must be dissolved it could take years.

    No you can't use it but why don't you do ABC Ltd t/a the name you want?

    I'm pretty sure that once a company has been struck off and dissolved, that particular name can't be re=registered. As a Limited company is an artificial entity, reregistering it would mean that that you would be liable for any debts etc of the original owners.
    Eat vegetables and fear no creditors, rather than eat duck and hide.

    I don't know too much about this but I know that this is 100% possible, without being liable.

    I guess I could...but I'm suuuuper anal about this stuff and it would be a shame to go that route.

    No they wouldnt , if they could reuse the name , they would have a different company registration number , its the company number that is important , not the name

    Bear in mind if you are trading as that name, especially so soon, you'll get all sorts of creditors of the old company assuming you're the same person/entity and hassling you for cash despite your pleas of being entirely different.

    If you are really desperate to buy the company name and want to prevent others snapping it up when it otherwise becomes available, you could try contacting the administrators of the current business with an offer to buy the name from them.
