Do I take BT to a small claims court?

Hi all,
I'll try and be brief and cut this down.
Switched to Orange home phone and broadband on the 20th of FEB (order placed)
28th of Feb, orange broadband goes live.(BT hub stops working, orange router works!)
14th of March - BT phone line "transfers"
Ok so today receive a letter saying I owe BT £51.38
I have emails in my gmail account which make no sense at all from March, and I think that they have said I ordered BT again, when I havent.
I received a FINAL (please define final for me) bill from BT. After all charges, calls etc had been settled it resulted in me being in credit by £83.83.
they set this to me as a cheque.
Few weeks later in March, £50 is taken from my account and goes to BT.
I call a few times to settle everything. I was called a liar by one person and said I never switched (I had the gmails on my phone in my hand) I didnt swear but could be heard to be becomming increasingly frustrated at this point.
At the end of the call they agreed they were at fault and sent me I£50 cheque for the £50 they had taken.
I go to the bank and cancel D/D
I receive an email around 22 MAY saying I owe £51.38.
After a 17 minute phone call to BT + someone's manager, the amount was to be credited to my account as they understood the error. The system was down so it would be done a couple of days after our phone call at 10:18 on the 22 MAY.
Received a letter today, saying without payment of £51.38, the debt will be passed to agency and credit rating affected.
I phoned BT. I have recorded the call on my mobile, (I think because I didnt tell them I was recording it I cant use it in court?) I dont know the legality but after being called a liar previously, and my (already below average credit rating) in jeopardy, I wanted some proof. I spoke to one person, and 2 managers.
The first manager hang up and phoned me back after 28 minutes (do they get into trouble if a call is more than 30 minutes?)
he phoned me back and passed me onto another manager. He says the charge is payable and I say "were back to square one" and explain everything again, for the 5th(?) time, and he says its £30 charge for leaving, and then call charges.
In previous phone calls, it turned out they were billing me for calls I have paid orange for, and that after the £50 cheque was sent to me, it was the end of BT for me. :beer:
Since the phone call just now, I believe the £30 would be if I left early? I was never told of any charge to leave BT at ANY time. I was out of contract and even retentions offer of nearly 1/2 what I was paying never tempted me to stay
Please someone help? Im angry and upset and hate this. Why cant they credit the £51.38 as they say they would and leave me alone?
I'm really stressed with it. Nearly 4 months after placing an order to go with orange they're still at me.:mad:

Another for "Order confirmation" and then a 4th email on the 25th saying BT order completion. I phoned up and they said I was still with them for broadband. I said no. The date of switching broadband was 28th of feb, as orange had said, the hub doesnt work, I'm not with you and my IP is of a different location.:cool:
ARGH please help. They have lodged "an escalated complaint" and I must wait up to 7 working days to hear from them. Can I post the phone call here or with they sue me?

As you owe them money, what will you take them to court to claim for?
It looks like anyone doing the sueing will be them for any money they believe you owe them.

Yes, after retentions couldn't keep me they gave me the MAC code. I gave this to orange at the time of the order being placed (the 20th of FEB)Baby daughter born 13.2.10 :j 6lb 11.5oz0 -

For info - you will not get far chasing BT to pay for lunch hours or stress - aa you cannot arbitrarily decide on an amount and expect them to pay. Only if they previously agreed to the fees you you be safe in attempting a SC action.

Thanks for the info and support. I dont want to take action I just want rid of them. I reset my bt logins and have found that the £51.38 was due to a broadband order being placed on march! Which I didnt do... So theres proof there that the charges have been auto generated in error. Im kn mobile at the moment bur when I get in I shall be contacting the BT rep above.Baby daughter born 13.2.10 :j 6lb 11.5oz0 -
Keep us posted - it probably is just incompetence, but there's a lot of that about these days!0

Belated congratulations on the birth of your daughter (and commiserations too - she must be at the 'terrible twos' stage now).Time has moved on (much quicker than it used to - or so it seems at my age) and my previous advice on residential telephony has been or is now gradually being overtaken by changes in the retail market. Hence, I have now deleted links to my previous 'pearls of wisdom'. I sincerely hope they helped save some of you money.0
