personal injury claim for 2 adults and 2 children for over turned car

    If you and your children are suffering physically and mentally because of what happened, you need to take medical advice as to how long this may go on for. Once you have agreed an amount for an injury claim, it will be a full and final figure and any issues which may carry on (possibly for years) will not be covered.

    My niece was involved in a motorbike accident and suffered quite serious head, leg and shoulder injuries, she has just received a 5 figure payout from her insurer, the accident was 6 years ago. Her consultant has now confirmed that her injuries are healed and that any further issues will be minimal.

    Apart from the last paragraph, this is exactly what I was going to say.

    i am in no rush just trying to get people personal experiences as i have never been in an accident before. and theres is no point in me going with the soliciters that my insurance have gave me who have told me it will be between 10 and 20% charge off my compensation as i legal cover wasnt included in my policy. i put to them if i go with another lawyer there is no fees they say but the other lawyer wont get me a good ammont for my injuries. as they dont care what i get as they get there fees anyway but this lawyer will fight for more as the more i gte the more they get.

    I agree about not rushing into things. You have 3 years anyway from the date of the accident, and you have no idea of the effect that the accident will have on you and your family in the future. I claimed a few years ago for an accident at work, but waited about 2 years, by which time I'd had 2 operations and 12 months of physio. I initially thought I'd be off work for a few weeks, then back to normal. If only..

    The main thing to concentrate on here is to make sure that everyone is ok, leave the claiming for a while until you are sure there won't be any further problems.

    To be honest, as your accident only happened 2 weeks ago, you sound a bit desperate to start the ball rolling regarding your claim. No amount of money can compensate for a lifetime of pain, take your time. Stressing yourself about who will offer you the highest amount is the last thing you need at the moment.

    Absolute rubbish.

    Any decent PI lawyer will get you the money you are entitled to.

    Sounds like a conditional fee arrangement is the way forward - you are unlikely to have to pay anything.

    Don't be persuaded by cashbacks and all that sort of thing unless the firm (and/or individual) comes recommended. If a law firm has to 'buy' clients, then you have to ask yourself why.

    Absolute rubbish; you need to let this firm know as soon as possible that you will not be instructing them in relation to this claim. The line that they will get you more for your injuries than other firms is a desperate and disgraceful statement to make. It is wholly inaccurate and you shouldn't believe it for a second.

    Their fees also concern me. If they have said that their fees will amount to 10% to 20% of the compensation as an estimation then that is fine, albeit it is not the advisable option to take. However, if they have stated that they will take a set percentage of your compensation which will be between 10% and 20%, then that amounts to a contingency fee agreement and is illegal in personal injury claims in this country.

    As has already been stated the correct approach here is to find a solicitor (not a claims management company) that you can instruct on the basis of a Conditional Fee Agreement ('no win no fee'). Don't feel pressured into making a decision as to which solicitor to choose; you have plenty of time to start a claim (three years from the date of the accident to be exact), so make sure you prioritise the medical needs of you and your family first, then go to a solicitor when things are a bit more settled.

    If a law firm has to 'buy' clients, then you have to ask yourself why.

    That's the norm!

    The law firms have to "buy" leads from the insurer (selling on their innocent clients hit/injured by a third party, often who have already paid the insurer too for this "legal cover")

    Those firms offering cashback/commission to clients as an incentive to instruct them are just cutting out the middlemen insurance companies (and saving some money too - the insurers get paid £800+ for selling on clients, the cashbacks direct usually don't go much higher than £500)

    been onto several companies. and they connot deal with me as scottish law is diferent from eng and wales.

    also the referal fees that are common in eng and wales eg getting paid to make a claim are outlawed in scotland. so if i had an injury i can get an extra £1600. total crazy.

    yet again scotland leads the way with policies whilst cameron and his cronies let the country down. the snp should be in charge of britain we seem to be first for every law and ban then england copies.

    (The Welsh Government has done quite a lot too. Free prescriptions, Commissioners for children and older people, no school league tables, potential scrapping of GCSEs............. but sure, it's all Scotland. ;))
