Section 75 Claim

Hi, a new boy here, Bought a Sat Nav at Caravan show last October, for use in year long tour which I am now on. Noted some problems with use in November and attempted contact with Retailer. No repsonse to telephone enquiry, no response to Emails. Contacted Credit Card co to seek refund in Jan, who constantly responded by mail despite several requests to use EMail. - delays experienced. Eventually managed to send a scanned copy of claim to Credit Card Co only to be told outside 6 mths and onus now on me to prove item faulty requiring independent expert to assess issues. In meantime approached the SatNav software company for assistance to be told software on unit is counterfeit/pirated.
As I am still touring, and to avoid jumping through the Credit Card Co's hoops, can I put ball back in their court as my approach to them was within the 6 mth time limit and it is only their administration that caused matters to go beyond the limit that was never explained to me even existed? Hope someone can advise.

That six months rule is law, not something made up by the cc co.

Have a read of MSE's Consumer Rights article where it explains during the first six months after purchase a fault can be assumed to be inherent, but after six months it is for the buyer to prove the fault is inherent.

Have you seen MSE's Section 75 Refunds article?
  • Thanks Wealdroam

I am aware of the 6 mth timescale but my claim started with the CrCd Co well within that period but despite requests to contact me by Email including secure Internet Banking messaging they continued to send letters to postal address - no good when touring in Spain with no access to printers/scanners etc. - Will look at the links suggested
