Car deposit refund

Hi All,
Here is my situation, i was due to sell my wifes car to a private individual on Monday, everything agreed blah blah, he then goes back on his word:mad::mad::mad:, so we had by this time foolishly or otherwise put down a deposit on a new car.
The deposit for the new car was from a dealer in England and as i am in Scotland it was all done over the phone (no face to face) and no mention was made of the deposit being non-refundable.
I phoned the garage and told them of the situation and they said if they sell the car within the week they will refund, am i not entitled to the money back anyway due to the distance selling regualtions?

Here we go again !
Rule 1: The book law states that dealers are only allowed to keep deposits amounts to what they can account for in law.
Rule 2: Human law says: That car dealers are generally at the "harder" end of life, they have your money and they will never give it back and any CCJ will just be put in the bottom drawer with all the rest that are attached to his LTD company with no assets to seize or sell. They know the game and it is their game you are playing, they decide who wins.
Common sense Law states : Deposits are a Bond of trust that you will complete the sale, if you dont complete, the deposit is lost as the bond is broken.
Legal Remedies, Sue the dealer, however see Rule 2 first.
General advice on Deposits on used cars for searches : Never leave ANY amount of deposit you are not prepared to lose if EITHER side decides not to sell the car, once your money is in someone else's pocket it is GONE.
