DSR and my rights

I ordered a bunch of products from an online store recently and today the parcel came, was signed for by someone else and looked a bit battered

Opened it up and essentially it was a big parcel because of an umbrella it had in it. Now the umbrella's handle is, I think, broken as it quite easily comes off (it did when I took it out of its packaging!).

As the goods are broken/faulty, how would the refund work? Would I have to pay to return the item or would this be refunded?

Under DSR, I can return my order still - however that would mean returning everything in the order - I opened the plastic wrapping for both jackets to inspect them and make sure theyre ok, so I guess this is reasonable - but really all I want to do is return the umbrella and get refunded for it and not have to pay for the postage.

One more thing: in this big order were a pair of earrings. They are still in their original wrapping but it states that for hygiene reasons, these cannot be returned. As they have not been used, surely this wouldn't be an issue - but if it is, does this invalidate the entire order from DSR?

Interested in thoughts on this. My two best resolutions are a refund for the umbrella and not having to pay to return it, or to return the entire order (at some cost to my time in having to investigate this and get the refund!)

    As the umbrella is broken, this falls under SOGA, not DSRs. You are therefore entitled to a full refund of the umbrella and are not liable for return costs.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Great, so in fact even if they dont consider it to be broken, the fact its basically crap (the handle will just come off - not a fit for purpose umbrella!) would mean that I just send it, keep a receipt and get a refund for the umbrella + postage.

    Sent a nice email, hopefully itll get sorted!

    If the umbrella is not broken, just not of the quality you expected, then in this case you need to rely on DSRs for a resolution.

    As you say, a nice email is probably your best starting point, but just how you describe the crap product and keep the seller on your side might be difficult. :D
