Vehicle warranty & service problems

I'm currently locked in dispute with Nissan re my van, which I bought second hand but thought I'd "inherited" the warranty. The book was stamped up at the right intervals but the previous owner had saved money by getting a non-Nissan dealer to service it. I believe that a European law (recently passed) made this OK now under what is called Block Exemption. CAN ANYONE TELL ME MORE? - I've found a bit on the web, but not much. Between them, Nissan GB & the local dealership have treated me appallingly - the worst customer service I've ever had by a mile. There is absolutely no synergy between them and a very complex & drawn out case (vehicle off road since 4/1/07) comprises a litany of misinformation / no information / ineptitude and (in the case of the dealership) extreme rudeness and...erm..shall we just say politely "economy of the truth". An example is that after all this time, they have only just told me that there was a problem with the service records....records they've had from the other company mechanic for weeks! I'm at my wits end and about to see a solicitor next week. I've kept meticulous records, including a comprehensive record of all calls / emails etc. Trading Standards have been of very little use, I'm afraid. :mad: Cheers

Not an expert, but I believe there are 2 issues here:
Firstly, I think the previous owner should have transferred the warranty to you. I know that with our (brand new) car there is a card in the warranty book that needs to be completed if we ever sell the car on. I think it's so that the manufavturer knows who to contact in the event of a recall/warranty work that needs to be done. You may have problems if Nissan refuse to tranfer the warranty to you without that having been done.
Secondly, the EU regulation says that non-manufacturer servicing cannot be a reason for the manufacturer to refuse to honour the warranty as long as te correct specified parts have been used. In your case this means that all replacement parts must be Nissan (not generic). If the servicing has not been done to these levels then the warrany is indeed void.

I have been told on a few occassions that genuine Nissan parts were used - but, to date, the other mechanic has been a bit defensive and not hugely forthcoming - I think he is anxious about being dragged into anything messy. He's promised a reply next week after consulting his solicitor. You are indeed right about the transfer - I have noticed a tear off chitty thing at the back of the service book, but I feel this is the type of thing many people would probably overlook & I can't see (I hope!) this negating anything. Trading Standards are about useless in cases like this.
Solicitor is by far the best way to go.
Also claim back his costs and absolutely all yours costs.
I notice in your post that you say phone calls and emails......you really should be doing everything in writing and be sending it recorded delivery you will always get a better response than phone or email0 -
Cheers. Yes, I agree re post / recorded delivery. In practical terms there has been far too much for this to be done with everything, but I have sent the really big stuff by this way. I also put "read receipts" on the emails. I found the director's details via a web company search & have sent all the stuff thus far to him by rec. del. He has had the courtesy to phone me & tell me he's looking at things - relationships totally broke down with the dealership, so I didn't think I could take it any further with them. Regards0
