Totally Baffled by replies - Any advice? (rbs and nationwide)

Over the last couple of years I have become better at handling my money. Prior to this I had about 5 credit cards over different periods as well as several loans - all with various companies.

As I hadnt kept any paperwork at all I followed the guides on mse and got my credit history which showed me the details of my history (although in terms of account numbers only the last 4 digits of accounts or card numbers).

I wrote to all my credit card lenders and loan lenders with the templated letter, including all the details I could (account start and end dates, last 4 digits etc) and a cheque for a £1 for each account.

Today I have recieved the first two replies.

The first is from Nationwide which says they enclose a copy of my credit card agreement (which is a terrible photocopy half cut off and spread over several sheets making it hard to read). I dont know if its the full agreement or what I am looking for. I think they are being awkward.

The second reply is from RBS. This is says they are unable to deal with my request due to (see ticked boxes) a) request recieved however the required fee of £1.00 is enclosed (note I have typed this as per their letter so I think its meant to say isn't enclosed - which it was and they've sent it back) and b)Section 78 can only deal with active agreements, and the required fee is £1. We have been unable to locate the account. if the account is fully repaid and closed we are not obliged to send documents under section 78.

The letter goes on to say:

"I have therefore returned your request to you. Please provide me with the correct information and/or payment required and this will be dealt with accordingly.

Please do not quote S78 if you are trying to obtain your credit card number for PPI purposes"

On my returned original is scribbled "no acc number". But all I could get from my credit history is the las4 4 digits which I included.

Are both companies being deliberately difficult or is it my fault?

I am considering using a PPI reclaim company, particularly if the others reply with similar problems. Are any of these okay to use?

I've just started entering the competitions (July 07). When I win I'll update this signature. Look on the bright side, I shouldn't have to update it very often.

    You will have to chase this info up through Sar request, this will cost you £10 per bank but this may get you the numbers you need to make a claim, if you use a claims co you do the above and pay the claims co a % plus Vat.
    Do the Sar and see what info you get back (ask for all info they hold on you), you will get all the help you need on here for free, you do all the "leg work" and the claims co are laughing all the way to the bank.

  • im in the middle of a claim with nationwide credit cards.. it cost me £10 to get a copy of all the information they hold on me including a photocopy of all the statements/ direct debit form.. shockingly i found on the form i didnt tick the box for ppi but for 6 years they've just been charging me for the fun of it..

    Ok, so I am in a similar position, with PPI being charged although each of my 4 card agreements has no tick in the ppi box. :(
    I have received the agreements from Barclays (originally an Egg card) and MBNA, but there is no mention of payment protection in any of them. They have enclosed a FAQ sheet about the Ombudsman, the original credit agreement (generally photocopied reduced size and almost illegible), my "up to date" Ts & Cs and my last statement (card accounts are now closed).

    Do I need to ask for the PPI agreement again? will this cost me £1 again? I think I remember being called and 'encouraged' to go for the payment protection by the bank, even though I was self employed att the time, but how do I know what the cover was without the agreement?

    Anyone got any ideas?

    PPI doesnt have an agreement. Not all PPI is taken at point of sale and doesnt get included on the agreement. Standalone plans won't and also plans added after sign up (which credit card often is).

    Why do you need the agreements anyway? You dont need them to make a complaint.

    Ask the provider.
