Royal Mail

I returned two items of jewellery to QVC using Special Delivery costing £5.40.

QVC said they didn't receive it.

I put a claim form in to the Royal Mail.

The two items were over £220.

Royal Mail have sent a letter today saying that the Special Delivery was delivered but that they couldn't give me a copy of the receipt since the Royal Mail office had been so busy that day with returns to QVC they don't have them.

QVC won't refund me since they haven't got the package and told me to claim from Royal Mail.

Royal Mail said it has been delivered but cannot prove it.

What shall I do now?

    You have proof of postage that should be enough. I once sent a package back to QVC which they didn't receive but because i could send them a copy of the Prof of postage they accepted that and gave a full refund.
  • No, I haven't, not any more.

    I had to send the original receipt to the Royal Mail - which they have kept.

    I have a photocopy of the claims form and the Special Delivery.

    QVC keep saying "claim from the Post Office"

    Now I am stuck!

    I might phone the Trading Standards Office on Monday, see if they can help.

    Request the proof of delivery - any form whatsoever from the post office. I would be tempted to say that you are taking legal advice and may go to the small claims court?

  • Well, you see, that is what this letter from the Royal Mail says - they cannot give me proof of delivery!

    Methinks that they should be paying up!

    If Royal Mail can't give you proof that the guaranteed delivery was completed then they need to pay up, I'd say.

    I would ask QVC to send you a signed declaration that they didn’t receive your packaged. Then, you’ll have two signed letters that contradict one another. Go back to Royal Mail with QVC’s letter and demand your compensation, as the onus was on Royal Mail to obtain evidence of delivery. If QVC fail to provide a signed declaration, you’d have to wonder why. Then, you’d have to pursue QVC.
