CCJ advice

Hi There,

I've ended up with a CCJ from a landlord who we've had a really trrible time with. Can somebody tell me please, does he have to accept a payment plan from me or can he demand the full amount owing (approx £800.00) in one go. He's giving me a hard time over it and i need to know where i stand. There is no way I can afford to pay it off in one fell swoop but I want to get the matter sorted asap.

    Are you sure you have a ccj against you? (Landlords don't issue them, they come from the court, and you should have known about the claim against you (again via court documents, not via the landlord)
  • And here in lies the problem,
    Firstly, we never had to pay a deposit, we had to provide a guarantor. (who he is now threatening with legal action over the matter even hough we have the ccj already)

    Secondly, we initially informed the courts that we did dispute the money we owed but unfortunately our daughter was admitted to hospital and we failed to make the dispute deadline in time, therefore, a decision to place the CCj on us was made by default against us.

    I fear i have now made the matter even more complicated!!

    If you don't owe this, then the ccj can still be challenged (read up on setting aside a ccj).

    Get some advice over this - maybe at the CAB.

    You may be too late to set aside if you didn't challenge when you had the chance.

    May be worth asking though... Depends on the case and circumstances.

    Or you can ask for the judgement to be varied to instalments that you can afford.
