Not 'fit for purpose'

Recently recieved some cushions as a gift from Dunelm Mill (so no tags attached). The dye has marked my wall (luckily I hadn't put them on my furniture) have contacted them and they say that I should have read the disclaimer. Have contacted Trading Standards who say that this is against my statutory rights and the product is not fit for purpose. I've written to Dunelm stating this - they sent a £10 credit as a gesture of goodwill. This isn't really about the money but the fact that they can sell a product that I cannot use as the dye just rubs off - why on earth would I check to see if there was a transfer of colour, they are cushions, you put them on your furniture! Any suggestions?

What would be an acceptable outcome for you? Problem is... the contract's not with you. You're the recipient of a gift and the SOGA only applies to whomever bought the cushions for you."Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0

Initially I wanted a full refund and recompense for the mess on my wall - but now I want them to acknowledge that this is a substandard product that they should not be selling. But nobody seems to care, because it isn't a high value item. We just put up with these shoddy goods!0

Dunelm mill, I find are very good at after sales service.
The problem you have is that the contract they have with regards to the purchase is with the person who bought them for you. Why get yourself all wound up, when the easiest option, would be to give them back to your friend who bought you them and let them sort it out? They should find that they have no problems.0 -
What disclaimer?0

It reads - 'Do not place on light coloured textile surfaces (including leather) as dye may transfer' But, as I pointed out to them - it is a cushion - it is meant to go on furniture - why on earth would you check for dye transferance, and what if you put them on dark furniture and wore light clothes?0

You've got a reasonable gripe, readhead. That's not the issue. The issue is that, as a recipient of a gift, you actually have no consumer rights at all. If you want a resolution to this, you're going to have to enlist the support of whomever bought them."Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0

That's a bit like having a label on an umbrella, saying "do not get wet."The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

But they may have rights as regards claiming damages for the wall. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
