Change in overtime policy

Hi guys, I've been in current job for just over a year but the HR department have just changed our overtime policy. The major changes were that when we work a bank holiday we don't get a day back in lieu and that instead of getting double time for working a saturday or a sunday we now get just time and a half.

My question is should I need to sign a new contract or something for these changes or can they just do it without us really agreeing?

    The changes can be done on the current contract with sufficient notice.

    Sufficient notice just needs to be reasonable in proportion for the change. 90 days would be enough, yes, or your contract / their policies may stipulate a time.

    If the overtime rate is written into your contract then usual practice is to reissue a new contract. If the overtime rate is written into a policy elsewhere, they'll just amend the policy (which forms part of your contract and T&Cs).

    With regards to BH working, they don't have to offer a day in lieu. BUT you still have to have 28 days paid leave a year (which can include BHs). That's the lawful minimum.

    So if, for example, you get 20 days annual leave, and 8 BHs (total 28 days paid leave), but now work 3 BHs and don't get those days back, that's not lawful, as you'd only get 25 days off, which is under the legal min.

    Sorry, just realised I didn't really answer your question. They should consult you (good practice) but they don't have to. They don't need your agreement. If they issue new contracts and you don't sign, then you can be deemed to have resigned.

    Ultimately there's little you can do, as long as you're getting your full paid leave entitlement. You have no right to extra money or days in lieu for BHs or weekends, but you do absolutely have rights to your 28 days paid leave a year.

    always wrth getting everyone together fo a stratagy meeting, the change will happen but try to get resonable notice and other changes to mitigate if possible.

    Is Sat/Sun overtime compulsory try to get that removed from the contracts

    Make sure the holiday allowances are not comprimised(covered above)

    There might be other things like avoid Sat/Sun by overtime in the week at the same rate if not allready at the higher rate.
