DSR's - do they apply to plants?

I have received some plants from Suttons Seeds that I am really angry about - they are distinctly smaller than I anticipated. They are described as "pot ready value tray". I checked the site before ordering and the pot ready plants are descrived as being 13cm in height, with no height given for the value tray only that they will be smaller.
I have received 6cm high plug plants. By no stretch of the imagination are they "pot ready" and clearly need significant growing on before they could be planted outside.
I have no greenhouse or cold frame so will struggle to grow them on. I have contacted customer services who have said there is nothing they can do. Can I return under DSR's or are they exempt as "perishable goods"? Is there any other legislation I can use?

Absolute rubbish. Don't ask them what they can do - ask for a refund because they have not supplied what you bought.
I had some honeyberries which I paid £15 for 3 - supposedly 'jumbo plugs' and when they arrived they were an inch tall. I got my money refunded the same day - but this was T&M not Suttons but the same applies. Offer to send them back if they need them to inspect but tell them you are not accepting them as they are.If you haven't got it - please don't flaunt it. TIA.0 -

I had a problem with Jersey Plants, ordered 50 pansies
The didnt supply but sent me 100 of something else and 30 of something else. We had absolutely nowhere to put these plants, we were giving away some of the original 50 anyway. We were going away on holiday in a day or two so just had to give all the plants away except for about 30 which we had time to see to before we wnt.
I emailed when we got back, expressing disappointment that they substitued my order with what I didnt want and generous as it was I couldnt accommodate them and had to give them away. They apologised and gave me a full refund. I still order from them but always put on the order - please no substitutions.
Stand your ground and tell them you want a refund.make the most of it, we are only here for the weekend.

They can do something - they can return your money! If they didn't have the plants you ordered they should have done that and told you they were not going to be the ones you were expecting.
I'd make sure I attached a photo taken against a ruler, and highlighted the promised size in the original order, also with a photo of said text.If you haven't got it - please don't flaunt it. TIA.0 -
I suspect they may not be coverd by DSR but that doesn't matter in this case, your complaint is, as mo786uk says, under SOGA.0

Plants rooted in a large plug tray format, which are smaller than standard pot readies. We have chosen this format where growing and despatching this way is better suited to the variety.
