Hi
Last week we were accepted for car finance at carcraft in leeds and left with our new car. awesome!!!
today we recieved a phone call from carcraft telling us they were collecting the car tomorrow due to the finance company backtracking on our agreement because they noticed i had an attachment of earnings of £9 a month on my wage slip (which we had already made carcraft aware of anyway). we have now had this car 8 days, can they do this to us???
we have yet to make a payment as the direct debit was in the process of being set-up and they have already sold our old car at auction which we traded in so we cant even get that back
any answers to my tale of woe??

what's the whole story?
what do carcraft propose to do about the auctioned trade-in?
under what legislation do carcraft propose to collect the car?
do carcraft maintain YOU misled the finance company or themselves?
all worth asking before you allow any collection.
good luck0 -
Thankyou for replying, to be honest carcraft are not offering any information at all, we are so confused. if somebody told us this was happening to them our initial reaction would be that they couldnt just collect the car like that.
As for the auctioned car, they say they got £200 for it but we cant get any proof of that.0 -

You have had a lucky escape. Run...run very fast and don't look back.
If you deal with these people, you will be setting yourself for a load of grief later on. Get your money back from them and never darken their doorstep again.
However, it really is their problem. They should never have given you the car if it hadn't passed fianance. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
What trade in value did they give you for your car its usually quite high from car craft as they earn more money from the finance and overprice the cars to start off with and what was your carbworth? What they sold your car at auction for is not really your problem either if the car was worth more. They opted to take £200 for it.0

Exactly these people (rightly) never let yu off the premises with the car until everything is watertight.
I realy do not know the legality of this but I would be telling them to return your car first.
The problem is they will claim you didn't tell them about the arresetment and that will be the club they beat you with. (But is that not what credit checks are for).
Good luck (I think you will need it, see the post where the garage are claiming the buyer stole the car)0 -
I can't see how nine pounds per month affects your creditability to honest, that's only a hundred and eight pounds a year. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0

Thanks everyone for your help...looks like i've got some serious phone calls to make today. Some really good advice there, i'll post later if i get anywhere.

Please let us know how you get on, I'd be fuming if that was me.
To cancel the contract, you'd need to be put back in the position you were before - which is with your old car. If they can't get it back, I can see they're probably in a bit of a tricky situation.
The obvious remedy for me would be giving you the extra cash to purchase a replacement for your old vehicle as compensation if they take your new car back.
Good luck!0 -
they should have kept your trade in in a compound until all legalities were sorted
i bet they still have your p/x0
