Supplied with Engine that Doesnt Work.

Hi all,
I need some help please.
I am currently having problems with a car engine I bought about a month ago.
The sump is leaking oil out (gushing more like it) I cant drive it for fear of doing further damage. The company I bought the engine from is replacing this BUT they will not pay for the labour.
They have also admitted to me that all their engines have the same problem and told me I shouldve had the sump off of my old engine before I swapped it for the new conditioned one.
This I dont understand because the bits I did take off of the old engine they wanted back and charged me the courier fee for them to pick it up.
They have told me that they shouldve told the mechanic at the time that the sump shouldve been taken off and re-used but if the mechanic I use had done this I feel like I would not have got my deposit back.
So I think they have supplied me with an engine which does not work properly and that they arent willing to financially help to fix.
Do I have a leg to stand on?Can I fight for the labour, oil etc charges that I am incurring?

is this a reconditioned engine?
if it is ive seen one of these delivered in the last month a vauxhall and they had just put the sump on with no seal luckily the mech found it before he fitted it
maybe your problem is with your mech rather than engine supplier
