Bankruptcy and Landlords

I have my appointment with the court to take my forms in to apply for bankruptcy on Thursday.

I have just been reading some past posts about the OR interview and I am wondering- how much will the OR want to know about your landlord if you rent? Will they tell them about the bankruptcy? Will they want a tenancy agreement?

We have never been behind with the rent ever but my landlord is someone I know personally and if I can avoid it I'd like it if they didn't know.

Is this a significant part of the OR interview?

    Hi Charlie, your BR forms will be filled in with your LL details so if they need to contact them, they can do. We rented a few months before BR and it wasn't mentioned in the OR interview and we didn't think it would be. I guess providing your rent isn't too high and nothing indicates a reason for the OR to contact them, they may leave well alone. I'm not even sure if ours contacted our LL, all I know is we haven't heard anything from anyone. If you are really worried about it, ask the OR if they intend on writing to the LL but I'm not sure why they would need to really, is there a BR clause in your agreement with LL?. Good luck.

    When I had my OR interview they never mentioned my rent, although I had to supply my tenancy agreement. I think that was just to confirm the rent expense.
    As far as I know, they never contacted the landlord.

    The OR contacted my LL just after my interview, it seems that some do and some don`t. I had already told my LL so it did not matter.

    BR Feb. OR at interview stated that she would contact my housing association as a matter of routine. Have had no comeback from association. I dont think they are to worried providing you have always paid your rent and been a good tenant.

    You could always ask OR if they intent to contact landlord. If that is the case may be better to tell LL prior to them receiving letter from OR.

    Hi Charlie, as Dojoman says this is one of those things that is not consistant. Some OR's will follow the guidelines to the letter and inform the LL but others will just check your contract and check if you are in arrears and leave the LL out of the equation. I told my LL and was glad I did as my OR contacted them and I had no rent arrears either.

    Bankruptcy always effect on leases, as landlords are there to seek details of automatic stay but generally bankruptcy courts don't grant to the property dealers very soon. Bankruptcy of debt is increased and cost of financing is replaced with debt. Generally Bankruptcy costly process to itself. Some firms choose their debt financing by trading off such bankruptcy issues.
  • My OR asked for a copy of my tenancy agreement - I asked if they would be informing my landlord (who is family) and they said no and as far as I know this is the case - so I guess ask them at the time, as it seems it's different depending on where you are BR.
