if my rented property should have been a HMO would i get council tax back?

My ex-rented property (moved out on Saturday) was 5 unrelated people renting together....

but the house was not registered by the landlord as a house of multiple occupation...i have reported it to the council and we haven't made the final payment of council tax yet....

my question is will the council refund what we have paid in council tax to us and bill the landlord instead??

  • No, Council tax is the responsibility of the occupants unless its stipulated in the tenancy agreement that council tax is included in the rent. If all occupants are/were students, you'd be exempt from paying council tax.

    Also, the house does not need to be registered as an HMO unless the local authority has a mandatory registration scheme. If the property is 3 stories in height with 5 or more unrelated occupants, then the landlord needs to apply for a licence.
