HMRC and Freedom of Information

Hi all,

New on this forum so bare with me.

I am in the process of making a claim against HM Revenue & Customs under ESC A19C (isnt going well at the moment).

In my last letter to the team dealing with my claim I requested that I receive copies of all documentation relating to my case this has not been forth coming and during a recent telephone conversation with the Tax office I was told that ESC A19C claims are exempt from the Freedom of Information Act

Does anyone know if this is true? or am I just being given the run around.

    No personal information will be given out if requested under the Freedom of Information Act. You need to be requesting personal information through a Subject Access Request under the Data Protection Act. Usually the information would be required to be given out, however there is an exemption in the Act that prevents HMRC from disclosing information held about you for the purposes of the assessment or collection of tax.
    Did you really mean to put loose?
    Lose: no longer possess, not to retain, unable to find
    Loose: not firmly or tightly fixed in place
