Groupon voucher - my tough luck?

I bought a voucher a few weeks via Groupon, for a suit for my OH. I got the original email saying thanks for your order, and we'll send you your voucher when the deal is completed.

I'm new to Groupon (bought one thing before). I must have been having a blonde moment, because I looked at the original advert and it said "deal expires 13 Mar 2012". For some reason, I (wrongly) assumed that I wouldn't get the voucher until then, and didn't check my email. :o

Now I find that in fact Groupon sent me the voucher the following day, and that it was only valid for a month and has now expired. I have checked the website of the suit company and it confirms that the code "is not valid".

Do I just have to chalk this one up to experience? I will obviously speak to the suit company tomorrow to see whether they will, in fact, honour the deal, but could anyone confirm that they do not have to? This was not an inexpensive mistake to make. :(

    I think this is a bit of a grey area. There is no law prohibiting this, however some could argue the expiry date is an "unfair term" thus unenforceable. Personally I don't think expiry dates are necessarily unfair, a month for example on a suit imo is reasonable. Whether a judge would agree is a whole different story.

    Saying that, all may not be lost. Email the company to enquire, if they say no then email Groupon and see if they can offer a refund. Failing that, you could always offer to pay an 'admin fee' if they honor the voucher.

    Failing that, going to small claims court is an option, although it's near really clear as to whether you have a strong case or not.

    Maybe others will come along and offer there thoughts/opinions shortly.
