How will taking previous employer to a tribunal effect future job propects?

To cut a long story short it looks like the redundancy payment service are not going to pay my redundancy due to a possible tupe transfer. So it looks like my only option to get my redundancy is to take my previous employer to a tribunal, but I am wondering how this will effect future job prospects? Obviously a reference will be out the window and I worked for them for 6-7 years so fairly long time. Any ideas how I go around this on a CV or application form?

    unless specificaly asked why tell them and it is related to unpaid wages.

    how long has this gone on, you only have 3months to make the claim.

    if it is a tupe then you should have a job

    2 weeks away from 3 months, Opened a claim yesterday. No one knows if its a tupe as they won't provide the information to the redundancy payment service, thats the problem, they have been asked twice by the RPS and twice they have ignored it, so what are they hiding? Yes I am aware I should have a job, so also a claim for unfair dismissal.

    If I apply for a job in the same industry the new employer is bound to find out, I live in a small area.

    If the work community is that small then what difference would a ET claim make vs. a known disagreement with a previous employer?

    On my CV is redundancy, I guess new employers would look at me as possibly a trouble maker even though i'm actually not the bad guy. But I won't be able to use my previous employer as a reference.
  • It's not something that you have to tell new employers

    Taking an employer to a tribunal to enforce a right means you have protection under law. You should not suffer detriment due to your actions e.g. getting an untrue reference.

    So I think you'd be surprised at how much your ex-employer would want to keep their business to themselves/are scared of a legal process. Not your usual type gossip over a pint - and there may be a confidentiality agreement in place over the TUPE situation which may also keep their mouth shut.

    References have to be truthful - and in most cases usually only contain a few lines - date of work, job title, reason for leaving.

    Tribunal or not, you probably will have to use them as a reference. Anyway you can find out what these look like?

    I would also suggest that you include the transferee as a second respondent on your claim if you haven't already done so. The tribunal may decide that they are liable for the redundancy payment.

    The same Jarndyce I have just seen mentioned on the redundancy and employment forum? If so then there seems to be more to this story than is in this thread.

    Yep there is quite a bit. I probably mentioned it in the redundancy thread on here several months ago, it involves tupe transfers and is quite lenghty
