Do I have any rights? Agency worker.

I have been working in a factory employed by an agnecy since July last year. This afternoon I have had a missed call and a text from the agency to tell me there is no longer any work for me.

I know for a fact the comapnay I was at is busy and has plenty of work and that the reason I am no longer required is because I had 3 days off sick last week and 3 days off sick this week. The reason for my sickness is down to anxiety after being told I need a scan. I have been up front and honest ringing the company when I cannot go into work, explaing my reasons etc and was told it was fine, not to worry, to get myself well and not to worry about losing my job!!

Do I have any rights at all to appeal this?? It seems totally wrong and now I'm worried not only about my health but also being out of work.

Your agreement with the agency will probably outline that no notice is required. I am afraid that is the nature of agency work. Sorry.

Are they due you any holiday pay? Good time to ask for it.

I thought there were new rights for agency workers being brought in last October to protect agency staff from this sort of treatment.

I'm so angry and upset :(

No outstanding holiday pay owing me sadly.

for info, in the first year, even if you were directly employed, you could be dismissed for any reason that is not related to a protected characteristic (eg race, disability). So not much different really.

The right to the same pay and certain conditions. You are however on a zero hours contract so no notice required..

Even if you had complete permanent employee rights an employee can be dismissed without reason in the first 12 months of employment.
