"yes" ticked in credit agreement

Hi everyone,
This is my first post so be gentle with me.
Basically i`m just starting the process of claiming back ppi charges from MBNA. I first got my credit card in 1997 and really only use it when im switching other cards balances to get a better deal. With all the fuss about ppi, i checked my statement and saw that i was paying ppi.
Just had my original credit agreement sent to me by MBNA as i requested and it has the "yes" box ticked saying that i agree to have payment protection. I wouldn`t have ticked it as i never have this type of protection. The "tick" is different to the other ticks on the form that i would`ve ticked,so is it possible that a third party as it were,has ticked the box after they`ve received my application? Where do i stand on this and can i claim the charges back as i know i didn`t tick the box? Do i have a leg to stand on?
Any help would be much appreciated and thanks in advance.

Ok, first a polite slap. You have had around 175 statements on this account since you took it out 15 years ago. Yet only now do you see the transaction going through. That is very poor financial management.The "tick" is different to the other ticks on the form that i would`ve ticked,so is it possible that a third party as it were,has ticked the box after they`ve received my application?
Or more commonly, you were talked into it and the seller ticked the box after you agreed to it.Where do i stand on this and can i claim the charges back as i know i didn`t tick the box? Do i have a leg to stand on?
it is not a strong complaint and after 15 years, it does look a little opportunistic. However, if that is all you have got then you will have to accept it is a very weak complaint.I am an Independent Financial Adviser (IFA).
