HSBC Reject 2nd Letter Bank Charge Reclaim

Hi all,
My partner has sent in 2 letters now to HSBC asking to reclaim bank charges. The first was quickly sent back saying no. In the second case a letter was sent saying they where still looking into it and the was followed by a No. They also said that they will not discuss it any more and that I can take further action if I wish.

Is the best thing now to go stright to the ombudsman ?

    It appears your partner's first claim was rejected because the bank thought your partner was attempting to re-claim on the basis of the charges being unfair.

    The subsequent letter clarified that the claim was being based on financial hardship grounds, but it appears the bank, after further consideration, also considered this to be unwarranted.

    Your partner could go to the FOS, but they have no power to overturn the decision, only to request the bank re-look at the application if they think it is warranted.

    But it sounds like the bank have already decided and they are reluctant to reconsider the matter. Perhaps the bank consider the recent payout of PPI premiums they have offered to repay you will put food on your table tonight, and hence why they consider you and your partner are not currently in financial hardship?

    Your partnert should talk to the bank and ask them for help in better managing finances to help avoid future bank charges.
    Also consider posting your SoA on the DFW board; you will typically get some very good advice there. :)

    At the bottom of the letter refering to the Ombudsman it does say "I can confirm that the bank will co-operate with them should they wish us to do so, and will ultimately be guided by their findings".

    So are you then saying that because they admitted they wrongly sold the PPI and have paid it back that a person is no longer considered to be in hardship ? Isn't it the case that you claim for hardship when all the fees etc are being charged to you by the bank ?

    We have been to CAB etc and reduced all bills to minimum and been to the bank previously etc so really there is no point going back to the bank to sort out what we already have done...they wont stop any charges so what would they do that we have not ?

    Most PPI refunds are goodwill payments and not an admission of liability or wrong doing. However, financial hardship applies to your current position. If you have just received a redress payment that takes you out of hardship then they could easily eliminate for that reason.

    SoA = Statement of Affairs
    DFW = Debt-Free Wannabe
