holiday

a friend who is considering bankruptcy has a lot of holiday days coming before april to take.

would the trustee consider this, if flights are payed for, withdrawals from cash machines abroad etc?

would they demand to see bank statements?

    Is this just lots of holiday days to book from work or have they already booked the flights etc?

    Spending beyond reasonable living expenses and cheap holidays would not be looked upon favourably if the person already knows they are insolvent. Can they take a budget break in this country instead?

    As a matter of course the OR will ask for at least 12 months statements and could possibly ask for more. If they know they are going BR then really they should be looking to cancel the holiday.

    It has been known for the OR to cancel holidays and claim any refund due.

    I was asked by the OR the last time I went on holiday and if any money had be spend on a holiday in the last FEW years,so I would think it wouldn't go unnoticed and so may not be a good idea.

    Hi we had a holiday abroad during our bankruptcy, the OR asked how we had paid for this, my mother had paid as a gift, OR was fine with that as allowed £80 per month for hols which we saved for spending money. Also during the whole process of our 12m bankruptcy we never had to give her any bank statements. Our bank confirmed that they wouldnt have gave any to her without our consent aswell.

    The bank told you wrong I'm afraid. The bank has a duty under the insolvency act to co-operate and the OR can and does request copy of credit cad and bank statements direct from the financial institutions. Your consent is not needed.

    we are talking about using credit for holidays BEFORE you go BR not after or before your undischarged and the OR does have power to see your bank records before and during your BR.

    However, if the holiday was already booked prior to going BR the OR will want to know about it, regardless of when the holiday is actually taken. So in this instance, the comment was relevant.

  • hi thanks all who gave me advice no this his 3rd letter 1st i said me some body helping him like fresh start but now we send them letter that we received but they send us back that latter whats gone happen plz plz help us i want to go all throu this is there any chance we can pay them monthly bases like 400 or 500 hundred pound a month plz plz help me
