First direct holding me to ransom??

Hi all, I used to be with FD but hit a few short term problems. I had a £1000 overdraft. I went over it regulary and they threw me out of the bank!

I at the them time agreed to pay it off £50 a month. Having done this for a few months I checked my credit file. They are and are still showing me as 2 months in arrears. I am not so called them. They have stated through equifax disputes that "at the time of the payment agreement I was two months in arrears so the "2" will remain on there until the full amount is paid off in full".

I have offered to pay three months worth in one go but they said that would not help and the "2" will stay on credit file until paid in full. Surely if I am up to date they cannot keep making my score look like this........ 2 2 2 2 2 2 2 2 2?????????????

Any help really apprecited.

    What is the overdraft limit of the account at the moment?

    If you reached an agreement with them, however, and they aren't charging you interest or fees whilst paying it off, they aren't reporting correctly.

    They should report the status as "AP" - Arrangement to Pay - like this:

    I suggest sending them a formal written complaint under the data protection act for reporting false and inaccurate information.

    They probably won't uphold your complaint and you'll probably have to take it to the ICO - good luck! :o :beer:

  • Thank you for the speedy reply. I am no longer with the bank (standfast paying off this O/D). The agreed overdraft was £1000. It is around £600 now.

    Your picture shows exactly what I am trying to say. At the time I agree for a couple of months I am happy they can apply the 2,2 etc but only for a coupe of months. Now I have been paying bang up to date for many months why are they still displaying all of those 2's??

    Are you behind with the agreed repayment plan?

    I.e. did the ask you to start paying £50 PCM on say, March 2010 but you started paying it in April 2010? Or forget to pay them £50 in June 2010 (or whenever)?

  • No not at all. Bang up to date and they agree this.I even offered to pay the "two" months on top of monthly payments, but they said there was no need. They claim the "2" is staying on "as when I entered the agreement to pay that is what the account was at the time".

    Since then I have paid EVERY month without fail. Their answer been even I if paid on time forever they will still keep updating it as "2" each month. So frustrating! Am I missing a trick here???????

    I think they are the ones missing a trick.

    Get a formal written complaint sent marked FAO: Data Controller.

    Like I say, they probably won't bow down. I had the same problem with Provident (yes, I know) when I borrowed money from them during bankruptcy to fix a leaky boiler - I ended up in an AP (yes, with Provident, I know...) with them and after the ICO upheld my complaint I had to call Provident each month to have them manually update my credit files to show AP as opposed to arrears - as their system doesn't have the facility for sending AP markers through to credit reference agencies through their computerised feed...

    So. Like I say. I wish you luck! You'll need it :beer:

  • Here goes with the follow up-

    They are claiming that the "2" should remain for the following reasons-I had one DD returned one month resulting in a "1" then the same again the following month resulting in a "2". Fair enough my mistake I can live with that.

    When my banking facilities were removed and agreement to pay the OD was made, "the status recororded is to remain so until the overdraft has been paid."

    I am not sure what paying the OD has to do with the 2 missed DD from previously?

    Any ideas? This is driving me insane!

    All help really appreciated.

    I'm sure izools will be back to provide further advice.

    However, I think it is clear that if you think the information is incorrect and the company are not willing to amend it via their complaints route, your next port of call is the ICO

    Or are you saying that it is the ICO that has provided this explanation for why the "2" is correct?
