Benefits during ESA appeal

Hi,

Hope someone can help. I have been on incapacity benefit for 5 years, Just before christmas the DWP turned down my claim for ESA. I am going to appeal against this.

The DWP have told me that during the appeal I will only get ESA at an assesment rate of £65.45. Quite a drop from the £99.85 I have currently been recieving.

Is this correct? If so I have no idea how I will be able to cope.

Will I be able to claim any other benefits, eg Income Support or JSA, which come in higher at £67.50?

Should I be claiming JSA whilst the appeal is going on in case I loose the appeal.

Any help will be appreciated.

    The ESA Assessment rate is £67.50, the same as JSA. You are not eligible for Income Support unless you qualify for other reasons.

    The DWP will carry out a Reconsideration before passing you papers to the Tribunal Service. If you have additional evidence or can show that your existing evidence has not been fully considered or mis-interpreted, then you may be able to get the decision overturned, otherwise you'll have to wait for a hearing.

    During an appeal then the assessment phase of ESA is given. If you win your appeal then the money you would have been paid will be back dated.
