Help opening a dispute.

As a birthday present for DG I bought a subscription for Xbox live on Ebay item 220884905436. Listing said location London and "Card hard copy will be sent via royal mail post" Well all I got was an email code and it did not work, message said it had already been used.
So I have sent several messages to seller who says they have sent a replacement but it hasn't arrived, They now are not replying to my messages and now I see they are in Dubai, not London!
So which is the best way to proceed?

Someone else with more dispute experience will hopefully come along but I would think the 1st thing to do is open a claim with paypal for Item Not Received. As the seller is selling a tangible hard copy then this should in theory be covered.It may sometimes seem like I can't spell, I can, I just can't type0

Generally vouchers of any kind are not valid under buyer protection

As Sazzarella explains. Vouchers are exempt. Sometimes if the seller has incorrectly listed the item, it may allow you to open a case on Ebay.
Hard copy is irrelevant, it is down to how it was sold.0 -
So is a membership card which is what I bought a voucher?
Anyway the seller has now apologized and sent a replacement code which we will try tonight plus a £5 discount.
Still don't know if I should make a complaint to Ebay about them not sending a hard copy and the item not being in London?? Is this normal for this kind of thing?
Just sent Ebay an email to clarify this as their rules refer to manufacturers vouchers which this clearly isn't. Will post their answer.0 -
Very pleased to report that the replacement code worked! Now just waiting for Ebay to say if I would have been protected if it had all gone pearshaped.0
