Car Accident - What am I best to do?

  • The picture quality is unusually good & you are lucky you got them without a fee. DPA is often quoted and fees charged to remove reg plates etc. Unfortunately its not in a good place to capture the incident well.

    I am surprised however that there is no time stamp on them?

    Looking at the images, I would argue a 50/50 settlement. As each frame progresses you can see more and more of the silver merc which, given the camera is in a fixed location, that it is still moving backwards through almost all the sequence. Without a timestamp on the images you cannot be certain but if the merc has stopped at the instance of impact the images would suggest it is a fraction of a second at most.

    Both parties were reversing and so both have a heightened duty of care.

    Assuming you are the merc owner, was there a photo of the damage to your car taken that you can share? I would more look to see if there were scratches or a clean dent. With a clean dent you could take a stab at arguing that the vehicle was stationary as two moving vehicles would scrape against each other. Its a long shot but I've had it work in the past but it isnt supported by the CCTV footage.

    If there were scratches to the merc that wouldnt automatically mean it was moving, could just be the other driver was slow in stopping after the impact or scraped as they pulled away but it removes the possible argument.

    No reason why you shouldn't send them in, but what do you want them to prove? (Cannot see any impact in the photos????)

    A still of the car reversing out the space suggests it was their fault.

    A sequence showing that you're reversing suggests a 50/50 to me.

    As you were reversing, you appear to have reserved off the main driveway, backwards over the give way sign, and stopped behind the car reversing out?

    If you had been going forward, from the direction of the lesser driveway of the McDonalds, and had been about to turn onto the main driveway at the end, (the exit?) and so approached the other car from the drivers side, I would have said the other party.

    You appear to have reversed from his passenger side, so if I was the other driver, I would probably be blaming you.
    The car park doesn't look wide enough for two way traffic, so I would look at the roadmarkings, and if it was one way only, that would be my submission.
    Is the road at the end one way, right turn only, or can you turn left from the drivethrough?

    Where do you come from to reverse, as I can't see your car before it appears behind the other vehicle?
    Did you reverse out of the space opposite?
  • I'd say you are at fault also. You said you stopped a split second before the accident, but between pictures 7 and 8 your car seems to have moved almost the width of a what looks like a Transit. If you were crashed into when stationary, would your car have moved that much? Your car doesn't seem to be in view until picture 6, when the Insignia is well out of the space. Could it be that you didn't see him making the manouver? Do you have pictures of the damage to the cars?
  • I'd say they will find you at fault, you were reversing BACK into the car park, where the other driver was merely reversing out of a designated parking space. Why were you reversing back into the car park? the still merely show you are in the wrong. That's my considered opinion.

    Looks like it will go 50/50 to me.

    Differences between picture 7 and 8 show both vehicles to have moved a similar amount.

    The vehicle in the space were reversing out as you reversed behind them.

    Maybe the video shows it differently, Tried uploading to youtube?
