Bit of a buy it now / message dispute

I had a product for sale on ebay earlier, and someone messaged me asking if i'd agree to sell it at a lower price. I said yes, that's fine, but the only way I could do it was to put a buy it now price on there, I told them the exact time i'd list it, and told them they'd have to be quick as i'd had other interested people and they'd possibly try and buy it too.

So I listed it at the buy it now price agreed, and within minutes of me putting the buy it now price up, somebody else swooped in, met the buy it now price and gave immediate payment.

I then received an email, 20 minutes later, from the person who I had agreed the price with, who has told me he'd be raising a complaint with ebay, and I should tell the other person a sale had already been agreed.

I don't believe i'm in the wrong here, I can appreciate it's annoying but I did say the only way I knew how to do this was by inserting a buy it now price, and I gave pre warning that he'd have to be quick, which he wasn't. Does he have grounds for complaint?

He has no grounds for complaint.

eBay messages don't form any kind of binding contract. You did your best and somebody else bought it as it's a public auction, and now the contract is now with the new buyer.

Just tell him you're sorry but there's nothing you can do.

Ooh, this one made me laugh.
What a numpty. What part of, you'll need to be quick didn't he understand.
  • Best to block him in case he tries to wreck any of your other listings.
  • I would imagine he will be contacting his legal team...........
  • Block him and don't even reply.

If i was the buyer i would have found it funny someone else pipped me to the post and bought it.

I would have contacted the seller saying if the sale fell through i would buy it for the agreed price and not to relist it, Just send an invoice instead.

At least i would have a slight chance of getting it. Complaining and moaning would get me nowhere except as already suggested, Added to the blocked bidder list.

You could though have approached it differently. If you had canceled the listing then done another listing as aBIN. Just listed as usernames listing with no info or pictures. Then sent the buyer the url. As long as you worked the cost of the relist in the price you would have then had a happy customer.

As others said the buyer has no grounds for an ebay complaint.

Doesn't the fact that someone else bought it so quickly make you think you under sold it? That's why I never take these BIN offers up as it's normally just someone fishing for a bargain and it sounds like someone had got one.

Not really, had an iphone 4, used, for sale on there for 300 quid for a week and didn't get any interest. Relisted it at 280, got a buyer within minutes. I'm happy to drop down 20 quid to get a sale and it's roughly the price people are getting for them now.
