I am feeling so flippin miserable.
Went to court today bcos I thought my application for the judge to sign the transfer deeds of the house had gone through. And NOTHING HAPPENED.
I had a letter saying that the ex had to sign else the judge would, and that was not enforced. Prior to that the consent order in 2005 gave the ex 56 days to sign.
He has not signed.
Me and hubby are stuck with a mortgage which continues to go up and up because we cant get a new one until ex's name is off the deeds.
I dont even know if anyone has an answer. i just want a moan. I am just pee'd off and am going to cry into some beer when the kids are in bed (hubby is at band practice - dont usually mind tonight is usually ebay evening)
Whats the point of flippin courts making orders which are then not enforced
Why does hubby have only posh beer in (as always) such as obscure belgian stuff, so I feel guilty that I have cracked one of those open!!
That flamin ex a*hole moved out in 2002 and he is STILL mucking up my finances. AAAARRRRGH :eek

Did the Judge give a reason for not signing the transfer document?
I think you have just struck unlucky here as it is not usually such a battle to get them signed by the court.
Unfortunately the courts are a bit pathetic when it comes to enforcing orders made. The higher courts are a bit firmer and I have known them to enforce a penal notice for failing to take a child to contact, but the lower courts just let things go on and on for no good reason. After issuing a 56 day warning and not getting a response, the judge should have signed the transfer by now.0 -

I had a solicitor she was !!!!!! she didnt even tell me i could apply for enforcement and allowed us to go ahead with a mortgage application even though she must have known we wouldnt get one with the exs name still on the deeds. Every time I wanted to do anything she said' hadn't we better ask mr **** Ex H  I think she was on his sideMember no.1 of the 'I'm not in a clique' group :rotfl:
