Notice of employment

I don't know if this is in the right place?

I'm working for a company who have lost a contract, the people involved in the contract are been transfered to the company who have won the contract by TUPE starting the 1st feb. I have handed in my notice ( 4 weeks notice as company policy) 2 weeks ago, and i have sorted out another job starting on the 12th feb.

This morning I received a letter from the company I work with now, accepting my resignation and my last day of employment will be 31st jan, as part of the TUPE transfer. I will be paid for a full month for january. I will have to speek to the branch manager on monday as i've no notice of been transfered ( all the other guys have had letters about this and have a meeting with the other company), and as I take it my employment is with my present company and 4 weeks notice is 4 weeks not 2 and a bit :mad:

Am I correct, or do they have a right to end my notice early. Surley I should be paid till feb 9th?

    Have you read your copy of your contract when you started working there? I'm not sure about most places, but I know mine personally if something's due to change in your contract, they will notifty in writing with a weeks notice, so it might be best to read through your contract and check all the fine terms, just to be safe, there might be a loopholed way they can.

    Not sure about this, but from what I've been told, you don't have to show up at the new place on 1st Feb AND you don't have to give any notice.

    We had this problem and didn't know how many people were going to show up for work on the first day.

    I'd go and ask at the CAB or something like that.

    I've checked my contract- it requires to give the company a minimum of 4 weeks written notice. The company, on its part will give you 4 weeks notice.
    Would it be unfair dismissal if they terminated the contract during the notice period without payment to the end of the notice?

    It sounds to me as if the HR department has got confused, thinking that you are leaving because you do not want your employment transferred. In this case your employment would end on the transferral date and they are quite right in not paying you up to any other date.

    Take it up with your manager and/or your HR department, restating your leaving date and that you intend to work until that date and that you have no objection to transferring and are handing in your 4 week notice in the usual manner.

    Thanks, this is what I was thinking, i've had a look at the DTI website for info.
    I'll be speaking to my manager on monday to sort it out.
