Ebay Item Not Received Advice For What To Do Next - Pls

I recently (two weeks ago) purchased an item costing including p&p £51.00 as of yet the item has not been received. Paid via Paypal
During this time I contacted the seller stating that I'd not received the item. The response was that Royal Mail were probably being a bit slow and that they would send me the proof of postage which would probably arrive at the same time as the item. I received the proof a few days later, I emailed the seller saying that I was unsure of my next step as obviously the item was lost and I was out of pocket. The seller informed me that I would need to wait 15 working days before RM classify that an item is lost then I would need to complete the form and I'll get a full refund (sounds fab doesn't it?). I emailled back saying that I thought it was the responsibility of the seller to make the claim, the reply was that I could claim or they would claim on my behalf! ( No mention of a refund!)
So I obtained a form from the PO and that states you can make a claim for a maximum of £32.00! Hmmm not much help when I paid £51.00.
Ok so my point is am I entitled to a refund from the seller? Do I claim from Paypal? Or do I claim from Royal Mail?
If I should ask for a refund (don't fancy my chances) how should I put it to them without causing a problem and then getting into the messy business of negative feedback?

The certificate of posting is nothing to do with you, it is up to the seller to claim from the Royal mail. However as you paid by paypal you can start a chargeback with them and they will chase the seller for your money. At this stage I wouldn't worry about a neg , I'd concentrate on getting your money back.
In the first instance email the seller again and explan that the RM require the seller to claim, so ask naively do they want the COP returned to them, if they say yes then copy it and return it to seller recorded delivery.
Then put in a dispute via paypal explaining that no item has been received. In these circumstances I would go straight for the chargeback rather than waste time going through the dispute/mediate bit. As the seller cannot prove delivery you will win, it isn't your fault that the seller didn't use the correct postal method for an item of value, that is his loss not yours.
A couple of tips though, if this seller is still selling then put your chargeback claim in at the same time as his auctions end so that there is money in his account. Keep on top of paypal, log in every day to see what is happening.
This seller will no doubt start moaning about having his money stolen by paypal and will be yet another TSFE seller who has used paypal without understanding his obligations, but ignore that.

You should start a Paypal claim for item not recevied.
It is the sellers responsibility to ensure the goods reach you and if they dont they should resolve it with a replacement or refund. Dont let them fob you off with the Royal Mail claim procedure.
Stay polite in your communications simply stating the fact that unfortunately the item has not arrived after x number of days and there should be no reason for negative feedback from them (but some eBayers are a strange lot so who knows)
If the seller cannot prove delivery then you will get your money back through Paypal.

You Need To Be Quick With Your Paypal Claim, As By Time Paypal Finish Their Investigation The Seller Will Probably Have Taken The Money Out Of His Paypal Account And They Wont Be Able To Refund You !!
Make A Claim With Royal Mail As Well (keep Copies Of Everything You Send) As It Obvious The Seller Is Not Going To Help You !!
Royal Mail Will Contact Him/her Anyway To Clarify A Few Details...
I Have Sent A Claim In For An Ebay Item I Did Not Receive As The Seller Was Useless And Did Not Want To Send In A Claim, But He Did Reply To Royal Mail And I Got A Full Refund £28 Of Royal Mail !!0 -
Same as above make a claim, report to ebay asap they will investigate for you, and it might sound petty but leave negative feeback it will inform others that the seller maynot be trust worthy (do this after claim has gone through)Official DFW No*3540

Again, another TSFE seller. Make the paypal claim, but as everyone says, see if they are selling anything and put the paypal claim in just as there items finish - hopefully ensuring that there is enough funds in their paypal account to cover the claim, as you will win as they cannot prove delivery.0

Thanks everyone for your helpful advice.
Firstly is there a difference between a "chargeback" and a "paypal dispute claim" as I've looked on the website and it's a little confusing.
Also this seller is still selling and is also selling another of the item that I purchased! I did consided emailing and asking as I'd not received my item maybe they'd like to send me that one which ends in a couple of days time. I somehow think it would be a waste of time!
Just to get of my chest at no time has this seller apologised, I know it's not their fault that it's gone missing but when I sold an item that had gone astray I felt awful, was very apologetic and did everything I could to resolve the situation - which had a happy ending!0 -
Also this was paid via my paypal balance not from my credit card so I believe that I cannot request a chargeback?0

You can still open an item not received dispute.
As a rule you shoudl always use a credit card, but not using one doesn't prevent you from opening a dispute.
If, however, the dispute fails to get your money, you may be out of luck.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Do you get a choice when paying by paypal? I was under the impression that if you had a paypal balance from items sold when you purchased items paypal used that balance.
In the past when I've had no balance paypal always attempt to pay using my bank account which I have to change if I want to pay by the credit card listed on my account. Then there's always a warning about how it's safer to pay from the bank funding option.
So should I always try to pay by credit card? Is it safer?
