Hi - just wondering if anyone knows the law about working under your hours / week. My wife is a nurse and has been rostered to do a night shift. She normally works 9 - 5 mon - fri but needs to cover an overnight study. As a result she will not be able to work her full 37.5 hour week (in fact will be 5 hours short) and the employer has told her that she will need to make up the remaining 5 hours over the course of time - staying late etc. Is this fair? It is not her fault that she has not been able to complete her full working week.

This depends on what her contract/conditions of service say. No-one can advise without knowing that.0

Contract states 37.5 hours per week and is governed by national legislation (agenda for change)0

24hr cover jobs that have variable shifts will tend to have slightly variable weeks.
I have a feeling that A4C allows for this* but would have to check the exact contractual terms.
The enhanced rates for the night shift will come in handy.
* IIRC MY OH was rostered hours over a month so not every week would be exact hours.0
