Housing Benefit in Scotland

Hi there

Just wondering if anyone can advise if I can claim HB.

Husband and I seperated in July, the house is owned and the mortgage is in his name only.

I pay the mortgage and all the other bills each month.

Can I claim HB as Im basically renting it from him. He isnt coming back and I hope to take over the mortgage late next year once I hear if my current job is safe or not.

Im a single parent, work 20hrs a week and claim CTC and CB.

Any ideas if this is possible??

    it's a complicated situation, you normaly can't claim HB for a house you've owned (I know youu say your not on the mortgage but it was the marital home) also renting from someone your related to has issues. I think the only way you will know for definate is to apply and see what happens.

    Just an aside, when you say he's left is he working away from the area?

    No, we have seperated after a long, difficult couple of years he didnt want to try fix the problems and jumped straight into another relationship. :mad:

    My landlord is the parent of my child

    You won’t be able to get housing benefit if you are (or your partner is) responsible for a child and the landlord is a parent of that child.

    not sure if that applies in your case but if it does it looks like it is a no to housing benefit

    then I'd let him keep paying the mortgage if he's responsible for it and look for a rental somewhere where you would get HB, I think to be honest living in a house he owns could be more trouble than it''s worth, especially if it's not exactly amicable.
