Dismissal and appeal

I have been dismissed following alledged gross misconduct. I have decided to appeal this decision and my appeal is next week. I have since discovered that not only has my employer advertised my position but is holding interviews tomorrow for the post. Basically I wonder if they are allowed to do this as my appeal is imminent. It strikes me that by going down this route my employers have already discounted my appeal

    When were you dismissed and when did they advertise? How long were you in employment?

    dismmised 3 weeks ago, entered my appeal within 7 days and have been employed for 2 years.

    supply as much info as you can, reasons, excuses, what happened, dates, it will help the pundits advise, they are not renowned for coaxing info out of you, so spill the beans first.

    disnissed on 7th september appeal went in within 7 days, post advertised on 21st september. Dismmissed for comments on facebook which apparantly breached confidentiality and brought company into disrepute, that said, i made no mention of my employers, where i work or indeed what my profession was. absolutely no names were ever mentioned

    Ah. Facebook again.

    You were dismissed before they advertised your job. Your employment has been terminated - they can advertise. Your appeal has nothing to do with it.

    In addition, it doesn't matter what your profession is, nor names. They only need reasonable belief that you were bringing the company into disrepute.
