being accused of theft?!

Please help.

My other half walks for *** ltd, been there a year. He doesnt get on with his boss, sometimes he can be nice [taking all workers for dinner] and sometimes he loses his temper [trys to sack them]

today my OH has been surspended, over "theft".
he has a letter and this is how it goes:

"i have become aware of a number of tools going missing from the fabrication dept.
I have looked into the possible causes and have concerns over one operatives motives & actions

Occasion 1
During the last week of Auguest i observed *** driving his car into the third bay of the warehouse at 5pm.
He had asked earlier if he could have some cuts of timber,he then put a number of tools into his boot, including a 110v transformer unit.
the next day i asked him about the tools he had borrowed and he listed a cordless drill and grinder to do some work at home.
i asked if he had taken a 110v transformer unit to power the 110v grinder he borrowed and he said no he had not, but could he take one tonight?

he borrowed the transformer but toke it back to work!!

occasion 2

in mid august a bosch drill on loan from dewait to *** went missing?
i conducted a search and questioned all warehouse staff as if they knew of its wheareabouts?
in discussion with ****, i commented that as it was not peri property i was responsilbe for it and would have to personally pay to replace it if it was not found?
and that if it did no reappear i would consider phoning the police

2 days later ** approached me and made a big issure about if the tool had turned up yet? i responded that i had still no idea on its location and *** the pointed out it was sat on my desk in my office, he then told bothg fr
and j that it must of been in my office the whole time

HE WAS OFF THE DAY HE RANG TO ASK HIM WHERE THE TOOL WAS!

occasion 3
on the approx 1st september i was asked by ** if he could take a drill hme to do some work, he loaded a wheel barrow full of wood cut offs in **** bags and put a drill and hand plance on top of the bafs, the covered it with his fleece, i questioned ** what he had taken and he said just the drill. At 4pm ** parked the wheelbarrow outside the trasport office and went to clock out. i lifted his fleece on the wheelbarrow and alone with the drill was also the plane.. with roy smiths name marked on it
the next day i repeated my question and he replied yes and he had returned it

i have since checked the whole warehouse and all stores and the plaine is not in the warehouse.




i have no idea what to do!!!? i know for a fact he has not got the plainer or any of the bloody tools!!


what shall he do?

    I don't know how to answer your query but it's probably a good idea to remove the name of the employer and any identifying information from your post.

    Suspension doesn't necessarily mean he is accused of anything. He needs to get his union rep involved, obviously.

    Now you are going to tell me he is not in a union. Oh dear oh dear oh dear. When will people learn.

    Otherwise, he is going to have to wait until the investigation is concluded and respond accordingly when he is asked to. He will be entitled to be accompanied to any hearing (although not to an investigation interview).

    Above all, he needs to stay calm, as do you, and not post incriminating threads on message boards.

    Don't mention it.

    Look, you can ignore the advice if you like, thats up to you. I don't care. All I know is that if I'd been suspended I wouldn't want my wife getting all hysterical on me and posting on a message board telling the world how to identify me.

    As to your union point, oh dear.....Ok here goes. Anyone can join a union if they wish. They don't have to be recognised by the employer and other people at the workplace don't have to be in it. If he had been, he would get representation, advice and the employer would be under a little pressure to do things properly.

    And please, when he does get the opportunity to respond, tell him to do it in a calm, factual and professional way. If there is no evidence against him, then that is his best chance of not being charged with anything. But if he goes in kicking and screaming and claiming victimisation, that will put them on the defensive and looking for a reason to get rid.

    Like I say - that's my advice, take it or leave it.

    Being in the habit of borrowing tools so much, even if everyone does it, does leave him open to accusations, especially if there is no formal logging process for who has borrowed what.

    This will come down to his word against the bosses unless he has witnesses. I don't know what help to offer; I think he is on thin ice.

    Its about your OH yet you are posting here in a very silly manner.

    You have *still* left in the company name, and even named a person who works for them!

    And its there forever now and google cache the pages.

    Please get off the internet and get some proper advice (solicitor, union, whatever).

    You are not helping his cause.

    In fact I would go so far as to say that by posting the company name and people that work for it, he is now in more trouble than before and makes any reconcillation even harder.

    What if the company reads this.

    OP, please take Jarndyce's advice whether you like it or not. He will get no union help now, so there's nothing you can do until the investigation has taken place.

    If he's called up for a disciplinary hearing then he has the right to be accompanied.

    Borrowing (or bureauing?) company tools is a very silly practice, though, and bound to leave him open to criticism.

    By the way, you have still left some of the names in your original post; you really need to take these out.
