    Article 1 : ORGANISER
    Air France, registered with the Bobigny chamber of commerce under the number 420495178, a private limited company with €1,901,231,625 in capital, headquartered at 45 Rue de Paris, 95747 Roissy-CDG, France. Air France is running an online game in English and French based on the theme of its advertising films and titled "L'Envol" (Take-off). Participation is free of charge, no purchase necessary. The game shall run from Tuesday 14 September 2011 at 9:00 a.m. CET to Monday 26 September 2011 at 11:59 p.m. CET.
    Article 2 : PARTICIPATION Participation in the game is free of charge and no purchase is necessary, however, it is reserved for persons over the age of 18 who are members of the Facebook social network (www.facebook.com), regardless of their country of residence. Staff members of the organising companies and their families (same name and address) are not eligible. Participants declare that they hold a passport which will remain valid at least six months after the date of departure and with which they may freely enter France or the United States (depending on the case in question). By entering this game, participants expressly and without reservations whatsoever accept the terms and conditions set forth herein along with all of their stipulations, the current Internet code of ethics, and all the laws and regulations that apply to free games. Failure to meet any of the terms and conditions set forth in the official game rules shall result in the participant's disqualification. The participant must have an internet access, a valid e-mail address and a Facebook account for the registration. This game and its rules are written in French and English only. Players will therefore need a good knowledge of at least one of these two languages in order to take part. In case of a disagreement concerning the interpretation, the French version will be considered.
    Article 3 : GAME ANNOUNCEMENT This game is announced through the Air France Facebook Fan page (www.facebook.com/airfrance) by posting messages on the wall of exchange.
    This game may also be announced through e-newsletters sent by Air France, invitations to members of the Facebook social network or other media such as the promotional banners on Air France's dedicated country websites or partners. Article 4 : PROCEDURE To participate in the game, Internet users must first become fans of the Air France Facebook page by clicking on "Like" (English) or "J'aime" (French) on that page. The page is available in an English and a French version. If they are already fans of the Air France page, this step is not necessary. The game proceeds as follows: To play, the participant must download the "L'envol" game application on Facebook. After clicking on the button "Play" (English) or "Participer" (French), which starts the game session, the participant must click on his/her zone of residence on the map that appears. Depending on the selected zone, the participant shall be redirected to one of the following:
    - Europe zone application
    - World zone application
    Once the participant has been redirected to the application dedicated to his/her zone of residence, he/she must check the following boxes to confirm each of the conditions for entry: "I am at least 18 years of age / I have a valid passport / I have read and agree to the rules." After these boxes have been checked, the participant must click on "Submit" (English) or "Participer" (French).
    He/she must then answer a multiple-choice question; if the answer is correct he/she must then enter his/her name, e-mail address and departure city from the list of cities available.
    If the participant answers the question correctly, he/she will automatically be included in the grand prize drawing.
    If the participant answers incorrectly, he/she may play again.
    To play the game only one registration per person is possible.
    Each participant may play only for the prize corresponding to his/her main place of residence as indicated on the registration form when clicking on the map.
    Sharing the application: After answering the question correctly and filling in his/her personal information, the participant may share the application with his/her Facebook friends in one of two ways:
    • Posting an invitation to the game on his/her own wall
    • Sharing the application with Facebook friends he/she selects using the Facebook sharing module
    Article 5: DESIGNATION OF WINNERS This game shall have one winner from among all the participants residing in the World zone, and one winner from those residing in the Europe zone. The draw shall be performed under the supervision of Mr Jean-Louis Hauguel, Huissier de Justice (bailiff), on the first working day of the week following the closure of the game, which is to say Wednesday 28 September 2011. The names of the winners shall be announced by e-mail on 29 September 2011, the day after the draw. Winners must confirm acceptance of the prize within six days (6) of the e-mail notification. If a winner does not respond within this period of time, it shall be considered that he/she has renounced the prize. In this case, a new winner shall be designated as soon as possible by a draw from the remaining correct answers submitted by other participants in that zone. Winners must comply with the official game rules. If it is determined that a winner does not satisfy any of the criteria set forth in these rules (e.g. is not at least 18 years of age or does not have a passport valid at least six months after the departure date and allowing him/her to freely enter France or the United States depending on the case), Air France shall be unable to grant him/her the prize. Article 6 : VALIDITY OF ENTRIES Participants must correctly answer the question, fill in all the fields of the form required to register at the end of the quiz, and then click on the button "Submit" (English) or "Participer" (French). Incomplete or imprecise registrations shall not be taken into consideration and shall result in disqualification of the participation. Only one registration per person is possible. Any person registered with more than one e-mail address or more than one Facebook account shall be disqualified. Any attempt at fraud on the part of a participant shall disqualify all of the participant's entries.
    Article 7 :PRIZES
    The prize for the winner residing in the World zone consists of:
    The following conditions apply to the two round-trip tickets in prize: The tickets are issued only for direct flights operated by Air France, departing from the city selected by the winner upon his/her registration, subject to available seating and in the reservation classes dedicated to free tickets in Voyageur class (economy class N). The tickets may not be transferred or exchanged, are not valid for any compensation whatsoever (reimbursement of the ticket's unitary value in cash), and do not count toward Flying Blue miles. The winner and his/her guest must travel together on the same dates and on the same flights. The tickets shall be issued in electronic form only. The winner shall receive the flight details by e-mail. The departure is set for the 16 or the 17 December 2011(considering the departure city selected by the winner) for an imperative arrival in New York City on the 17 December 2011. The return shall be set before the 24 December 2011. The winner must choose his/her return date within ten (10) days after the day he/she accepted the prize. No modification of the return date will be accepted after the booking of the flights. The tickets may be used only by the winner and the person of his/her choice. The winning tickets are excluded from the Flying Blue programme. Even if the winner and his/her guest are members of this programme, they shall not accumulate any miles with these tickets.
    • Accommodations for one (1) night in New York City in InterContinental Barclay Hotel, 111 East 48th street, New York City, NY, 10017-1297 United States, in a double bedroom, breakfast included.
    • Two (2) tickets to a performance of The Nutcracker at the New York City Ballet (performance date: 17/12/2011).
    The commercial value of the prize is estimated at €2390 : €1800, average value of the price of the two (2) tickets, €400 for the night at the InterContinental Barclay and €190 for the two tickets to the performance at the New York City Ballet. The winner and his/her guest shall arrange for and cover all costs for travel between their place(s) of residence and the airports. The company Ariameetis will be in charge of the participant's transfer to and from the New York City and the InterContinental New York Barclay. All other expenses incurred by the winner and the person accompanying him/her to New York City shall remain their sole responsibility. Under no circumstances may the prizes be returned or exchanged for their cash value or for any other prize, or transferred to third parties. However, in the event of force majeur or if the circumstances so require, Air France reserves the right to substitute the proposed prizes with other prizes of equivalent value at any time. The prizes cannot lead to any kind of dispute or complaint whatsoever. The winners hereby agree to not hold Air France responsible for the prizes, particularly with regard to their delivery, state or quality
    Article 8 : MODIFICATIONS OF GAME DATES Air France shall have no liability whatsoever in the event that, due to a case of force majeur or events beyond its control, it must cancel this game, reduce its scope, prolong it, postpone it or modify its terms and conditions. Any modifications of the official rules shall be communicated to the bailiff specified in article 12. Article 9 :VERIFICATION OF EACH PARTICIPANT'S IDENTITY Participants authorise any verification necessary relating to their identity, date of birth, place of residence and membership in the Facebook social network. These verifications shall be performed with strict adherence to article 9 of the French Civil Code. Any false, falsified, fraudulent, misleading, incorrect or imprecise information provided in the identity details shall result in the participant's disqualification.
    Article 10 : LIABILITY Air France shall not be held responsible in the event should a malfunction in the Internet network prevent access to the game or hinder its proper functioning. In particular, Air France shall not be liable for any external malicious acts. Although Air France makes every effort to provide users with verified information and tools, it shall nevertheless not be held liable for factual errors (in particular related to displays on the game sites, the sending of erroneous e-mails to participants, or the routing of e-mails), a lack of availability of information and/or the presence of viruses on the website. By entering this game, players declare that they are familiar with and accept the characteristics and limits of the Internet, the absence of protection of certain data against possible misappropriation or pirating and the risks of contamination by any viruses circulating in the network. Participants must take all appropriate measures to protect against any infringement of their own data and/or the software stored on their computer and telephone equipment. Any person logging on to the website and entering the game does so under his/her sole responsibility. Furthermore, Air France shall not be liable for the following:
    • Telephone connection problems
    • Hardware or software problems
    • Destruction of information provided by the participants for a reason not attributable to Air France
    • Human or electronic error
    • Disruptions that may affect the smooth functioning of the game, or malfunctioning in the automated draw procedure
    • Cancellation or postponement of the performances at Op!ra Garnier or the New York City Ballet, or any consequences of traffic delays or accidents between the airport and the performance venue
    • Accidents personally sustained by the winner and his/her guest during the stay, including transport and travel, but not attributable to Air France
    • Damage or breakage of furniture and other objects that may be present in the hotel and at the Op!ra Garner or the New York City Ballet
    • Air France is not responsible for the consequences of any delays, loss, theft or damage of postal or electronic mail that are not attributable to it. Recipients must make any claims directly to the companies responsible for routing such mail.
    In any event, if the smooth administrative and/or technical functioning of the game is disrupted by a cause beyond the control of Air France, it reserves the right to halt the game. Any fraud or failure to comply with these rules may result in the perpetrator's exclusion from the game and Air France reserves the right, if necessary, to prosecute such persons. Air France shall not be liable for any physical inability of the winners or their guests to travel by air or enter France or the United States as a result of an irregularity in their documents (absence of a visa, absence of a passport, expired passport etc.). Article 11 : REIMBURSEMENT Participants accessing the website using a modem and telephone line for which the service is billed according to communication time or by calls made may receive reimbursement of the fees associated with connecting to Facebook. This reimbursement shall be established on the basis of a daily flat fee corresponding to the cost for 6 (six) minutes of local telephone communication, taxes included, made from a fixed line. The cost to the participant for making this request (price of a postage stamp for standard delivery) shall be reimbursed upon request. Only one request per participant (same name and address or same e-mail and/or bank details) shall be taken into consideration during the entire game period. Given that with the current state of service offers and technology, certain Internet service providers offer free or flat-fee access to users, it is expressly agreed that any visit to the website made using a free or flat-fee connection (for example via a connection by cable, ADSL or specialised connection) shall not qualify for reimbursement. Similarly, any request for reimbursement must be made within 10 calendar days of the date on which the telephone bill is received. This date shall be determined according to the date indicated on the bill. The reimbursement request must include the following: participant's name, e-mail address and physical mailing address (these must be identical to the information provided on the game registration form), bank details, date and time of the person's entry into the game, e-mail ID and password and, as soon as it becomes available, a photocopy of the bill from the telephone operator and/or Internet service provider indicating the dates and times of the connection, which must be underlined on the photocopy. This photocopy shall serve as proof of the person's residence. The name and address of the person requesting the reimbursement must be the same as those appearing on the telephone bill.
