executor of wills?

Hi all,
after a recent long illness my mother has passed leaving an elder brother as executor of her will.
does this have to be undertaken in front of witnesses, those parties who named as benefactors..... but moreover is it best to conduct this in a solicitors chambers or certain place?
wanted to make sure that we follow usual protocol without paying for some legal bod telling us the best way to conduct proceedings.

  • Sorry to hear of your loss.

Your brother needs to contact your local Probate Registry and ask for forms to complete for a Grant of Probate. There is absolutely no need to contact a solicitor. You can find your local Registry here:

  • Depending on how complicate dthe estate is he could do it all without a solicitor. When my mother died I went to see a solicitor and he told me not to waste money and just do it myself which was nice of him. Anyway, I got a book on the subject and found it really easy.

Go to the Court Service website and you will find all the information there that you need about probate.

If you go into the forms section and search under work type, selecting probate, you will get a list of the forms and leaflets you need which can then download.
