Sick Leave & Holidays ?

Could anyone tell me if holidays already booked off from work are made void by being on sick leave ?
O/H has holiday dates coming up but is , at moment , on sick leave and it would seem that o/h will still be on sick leave when the holiday leave comes round .
Answers on a holiday postcard please ..........:):):)

    As above says, cancel the leave. He wont lose the entitlement because he is on sick leave and he even accrues holiday during this time.

    But if he is going away on holiday, then no it doesn't void the annual leave. While on sick leave you are still contracted as normal, and you may not go on holiday without booking it etc. Some employees think that sick leave is "the new holiday" - get caught on holiday without permission (and I know you already have permission - I will come back to that) and you risk being sacked. Providing his doctor has said that going on holiday is no risk to his condition / health, the best thing to do would be to remind the employer that this holiday is booked (assuming you are indeed going away) and the doctor has cleared you for travel, and ask the employer. Some may not count this as holiday - but many will. You can be both on sick leave and on holiday at the same time - and you can be dismissed whilst on sick leave. It is best never to give the employer ammunition - "too sick to work, not too sick for two weeks on the beach" - unfortunately those people who have used sick leave for extra holiday have soured some employers to the point where they are very hard indeed on such matters. Best to keep them in the loop. If they insist on it being taken as holiday then you aren't loosing anything by it, but you are gaining peace of mind that everything is above board.

    SAR EL, the above only applies if they are indeed going away, if they are sick and cant take the holiday then they can defer it if they want. is this what you mean? also depending on the sick pay received from the company they may not be better off because surely they cant get sick pay and holiday pay at the same time can they?

    Yes - I did qualify what I said by saying that it applied if they were going away on holiday. And it isn't about being "better off" - although they may be because if on reduced pay or SSP then holiday pay (full pay) kicks in - it is about being carefuil that you have a job to come back to. Some employers do not nother about people going away whilst sick, but it is best not to find out after the event.

    You'll also find that a number of employers will actually, if approached, agree to holidays in cases of long term sickness as a recouperative measure, certainly mine decided that a few days following everything I'd been through would be beneficial for the rest it would give - that being said that was more to do with the fact that when I considered it in the first place I informed my manager thinking I'd already be back at work!

    I had this year (wasnt going away, had a week booked). Went to doc and was signed off for two weeks sick, including the week I was already off. I phoned HR and they immediately said I would get my holiday back. I had not expected this, although I took them up on their kind offer in the end ;) (esp as the reason I was off sick was I was working stupendously long hours..!)

    Just to clarify , will not be going on a holiday but the dates were booked for holiday leave over 6 months ago with the intention of going but now on hold (the holiday that is )
