Can a Head dismiss someone?

I was dismissed by the Head after threats from HR. Do the Governors have a say in a dismissal or can they be totally left out?
The next question is, Do they have any say in who is appointed and is there such a thing as "strong or weak" Governors?

  • No, the school was not that well run and the senior admin officer has just left with no notice. I have read guidelines and there should be a process with Head and Governors. But this has not been followed, so is there another rule?

    Should be a usual system of warnings - verbal and written - whatever role in a school but Gleeful is right 'gross misconduct' can be instant dismissal. You should have something in writing to explain your dismissal either from school or LA if a LA school, if not then ask for reasons in writing if you are unsure. If you were teaching staff then there is a very clear procedure in place in school teachers pay and conditions document. If HR have got involved then it doesn't need to go to governors unless it is a church aided school where they are technically the employers not the local authority. HR will have advised the head before he made a decision and usually they are water tight on these things but it may be that procedures were not followed and the head hasn't told them this.

    The head is the only person who has power of hiring and firing within a school! Although he can sub these responsibilities to others at times.

    You should have the ability to appeal a dismissal within a school and the this will be heard by someone else. If the head has not gone through proper procedures this is the easiest way to win an appeal.
  • I already posted about my sacking , but this is more about the role of the Governors. My job was caretaker, but after 4 months my CRB showed a record of handling stolen goods 15 years ago. Which I ticked on my CRB and spoke about the offence. The main question is if the Governors have any say ?
    I aim to start legal action this week and am just waiting for one of the Governors to get back to me as they are not happy with the situation.
