Section 75 - paid over 2 cards.

Hi all - I paid for services for about £2500 over 2 credit cards - a deposit and 2 final payments. Unfortunately the company went in to liquidation and I am claiming under section 75. One of the credit card companies has accepted my claim - but only on the amount that I paid using that card (£900) and had advised me to contact my other credit card company to claim the remainder . Can anybody validate this piece of information or is the credit card company trying to pull the wool over my eyes and trying to get away will agreeing to pay me less of a settlement figure?

    They should not care (though maybe you should not have mentioned it) - the section 75 claim is for the whole amount that you are out of pocket. Even if you paid £1 on this card, and paid £19999 cash, they should get you the £20k back.

    If you paid with two credit cards, you may actually have a choice who to call with your claims, but any of them would be responsible for the whole amount (but you must not get back more than you spent - no chasing both for the complete sum).

    So, for example, a customer who pays a deposit for goods – using a credit card issued by firm A – and then pays the balance using firm B’s card, has the choice of claiming for the cost of goods and any consequental losses against:
    • the supplier of the goods;
    • firm A;
    • firm B; or
    • all three.
    Note the words "consequential losses". If you have any such losses, over and above the value of the transaction, arising out of the issue itself don't forget to claim them from whoever you decide to claim from.

    .....but, as usual the slimy banks are trying to offload their legal responsibilities onto someone else...........or, even better, make you give up and go away.
