mis-sold Credit card

I got a credit card from halifax recently sold to me as interest free on purchases for 9 months. I have noticed though that interest was being charged so called them up and they refunded the interest but told me to go into branch as they will be able to clear it up. I have a fair amount on the card so don't really want to cancel it, how bad is it of them to have done this ? so i can tailor my demands appropriately.

    Sounds like a mistake on their behalf more than mis-selling. If they refund all interest charged and honour the nine months interest free from now on, then what have you lost?

    I would not say they have mis-sold you the card, however there has been an error and from what you have said they are aware there is a problem and told you to go into a branch to get it sorted. I would just go into the branch and see what they say and should hopefully sort it out, if not the re-post and we can take it from there.

    Out of interest was the balance on the card from a balance transfer and purchases or have you made any cash withdrawals?

    "miss-selling" is only relevant to certain categories of financial products. Generally those where there is some kind of duty on the provider to determine that the product is appropriate for the customer.

    In general, credit cards cannot be "miss-sold". Terms are agreed, and you have the right to expect those terms to be carried out. It is up to the buyer to determine if the product is suitable for them.

    (There can be an issue of "misrepresentation", but that is not relevant here.)

    A couple of things here:

    1) You have been provided with a set of terms and conditions which include interest rates. What do these say about a 0% deal?

    2) I suspect you've been sold a Clarity Card which has no interest free period. Should you have been sold something different? Did the branch have an interest free alternative to sell?

    Assuming they've sold you the wrong card you need to ask them to:

    a/ provide you with the correct card

    b/ transfer the balance from the incorrect card at no fee

    c/ refund any interest charged so far

    d/ compensate you for the time and effort you've had to put in to resolving this

    I was sold the cancer research card which i was told had 9 months interest free purchases ( balance on the card is from purchases) and when i called they told me no "special offers" are showing on the card. I will go into the branch on monday and see what they say, yeah I was hoping they would refund all interest over the 9 months and maybe a little something for the wasted time. will post what happens on monday.     Were you sold this in branch?

    Earlier this year I had a couple of simultaneous guaranteed card offers from my branch. One was the Reward Clarity card and the other was a Charity card. However, it was made very clear to me that, because they were branch offers, the Charity card did not come with the standard 9 months 0% on both BTs and purchases.

    It may well be that the 'advisor' dealing with you was ill-informed, or made an assumption that their offer was the same as that available online? Either way, the T&Cs/agreement provided (and signed) will detail the features of the product obtained.

    'Demands' for what? They've already refunded the interest so you've lost nothing. Quit throwing your toys out of the pram.
