Claiming back Cardholder Repayment Protector on HSBC credit card

Hi,

Hope someone can help me....

I've just started the process of trying to claim back the (recently cancelled) Cardholder Repayment Protector on my HSBC Gold Card that I hadn't even realised I was paying even though it was first taken out over 10 years ago!

In response to my letter requesting information on the original agreement (mentioning sections 77-79 of the Consumer Credit Act 1974, as recommended here), HSBC sent me a rambling letter full of legalese, basically saying that they're not under any obligation to send me an actual copy of any signed agreements, and instead have sent me a 'reconstituted' form with all the useful information missing - i.e. dates and signatures!

I've read here that my next move might be to send them a Subject Access Request (along with £10), as I guess I'm also going to need all past statements to work out how much I've paid over the years. But I also read somewhere that they probably only keep records going back about 6 years, so maybe there's not much point in doing this?

What should my next move be? Maybe I should just try to fill out the Financial Ombudsman questionnaire as best I can, though the only info I have is that the insurance started somewhere between 1998 and 2001 (thanks to the address on their 'reconstituted' form).

Any advice would be welcome... (by the way, I was working at the time I got the card, but this is definitely not something I would have willingly agreed to, as I don't use credit cards that much and have never missed a payment).

Cheers!

The sale is so long ago documents dont exist anymore, they are allowed to provide reconstructed documents.

You say you took out the PPI over 10 years and have only just noticed, it would appear on all statements since, it just doesnt give your arguement much creditability.

You also say you were working, this is fine and shows you were eligible for it, the PPI covers your payments if you are unable to work due to an accident, sickness or redundancy.
